ORDER This Criminal Original Petition has been filed to transfer the FIR in Crime No.408 of 2022 on the file of the 4th respondent Police Station to the file of the CBCID and to file final report within a time frame that may be fixed by this Court for a fair and effective investigation.
2.The petitioner is the wife of one Sathish (Hereinafter referred to as 'Deceased') and she is at R.C Street, Kottai Medu, Kattumannarkovil, Udayargui, Cuddalore. They have two children aged about 13 and 11 years respectively.
3.On 13.06.2022, the petitioner lodged the complaint to the 3rd respondent Police, namely, the Inspector of Police, G2 Uthiramerur Police Station, Kancheepuram District stating that she was living with her husband Sathish (Hereinafter referred to as 'Deceased' for convenience) aged about 40 years. Prior to fifteen years, they got Page No.2 of 26 married and they have two female children aged about 13 and 11 years respectively. The petitioner's husband Sathish was a Painter by profession and he was in the habit of taking excess alcohol regularly. For the past three years, he has been consuming excess alcohol, due to which, he was in the confused state of mind and he himself used to dash against the wall and door often and get injured. On one occasion, the petitioner's husband consumed rat poison, immediately, he was admitted in the Government General Hospital, Kattumannarkovil. After two days of treatment, he was discharged from the hospital. During the month of April 2022, he was in confused state of mind, hence, he was admitted in Mahatma Gandhi Hospital, Puducherry on 19.05.2022. The petitioner's husband refused to take treatment as inpatient and forced the petitioner to get him discharged. On 9th June, 2022, he fell down from his bike and sustained injuries, thereafter, the petitioner called her younger sister Keerthi, who is in Bangalore. The said Keerthi informed the petitioner that the deceased to be taken to Jesuit Ministry to Alcohol and Drug Dependents, Ongur, Uthiramerur. Page No.3 of 26
4.On 11.06.2022, at about 03.00 p.m., the petitioner took her husband and admitted in de-addiction centre where the Rev.Fr.Masilamani admitted him in the centre. The petitioner stayed overnight there, then on the next day, she left to her home since she had to take care of her two school going female children. On 13.06.2022, at about 06.30 a.m., the petitioner received a call from the Rev.Fr.Masilamani that her husband had sustained self inflicted injury on his head, hence, he was taken to the Government Hospital, Uthiramerur where he was pronounced dead. The petitioner lodged a complaint to the 4th respondent Police to arrange Postmortem and to find out the reason for her husband's death. On 13.06.2022, the 4th respondent Police received the complaint, registered FIR in Crime No.408 of 2022 under Section 174 Cr.P.C., and thereafter, no proper investigation conducted. The 4th respondent Police projected the case as though the petitioner's husband died because of self inflicted injuries sustained by him on his head in the bathroom in de-addition centre. The petitioner received the Postmortem certificate on 11.12.2022, that is, five months after the occurrence. The Postmortem report received that 'the deceased would appear to have died of Asphyxia due to constructive force around the Page No.4 of 26 neck'. The petitioner finding foul play in the investigation, sent representation to the respondents, who despite receipt of the same not taken any steps to find out the truth. Hence, the petitioner filed the above petition before this Court on 21.09.2022. The 4th respondent Police knowing well that the above petition is pending, had prepared Further Action Dropped report on 15.01.2023 and presented the same before the concerned Magistrate on 15.02.2023, thereafter, RCS notice sent to the petitioner.
5.Learned counsel for the petitioner submitted that the 4th respondent Police/Investigating Officer projected the case right from the beginning as though the petitioner's husband died due to self inflicted injury on his head. While admitting her husband, the petitioner given brief history and the reason for her husband admitting in the de-addiction centre. The petitioner informed Rev.Fr.Masilamani, Incharge of the de-addiction centre about her husband tendency of getting self inflicting injury by dashing the wall and door and further, he was alcoholic person with disturbed mind and he used to behave violently. Taking que from the same, from Rev.Fr.Masilamani, Attender Kennedy and other co-Page No.5 of 26 patient Ashwin Jerald, statements recorded in the same manner. Rev.Fr.Masilamani stated that he was informed by Kennedy and Ashwin Jerald, thereafter, he took the injured Sathish to Uthiramerur Government Hospital in Bolero jeep. Kennedy stated that he saw the deceased Sathish sitting in the bathroom and thereafter, he informed Ashwin Jerald who informed Rev.Fr.Masilamani. The said Ashwin Jerald stated that he informed Rev.Fr.Masilamani on the instructions of Kennedy. The first person saw the petitioner's husband is Kennedy, who not disclosed the true facts.
6.Learned counsel further submitted that the Sub Inspector of Police received the information, registered FIR, visited the scene of occurrence, prepared Observation Mahazar, Rough Sketch and sent the body to the Government Hospital, Chengalpet. In the presence of Jayaseelamani and Dinakaran Observation Mahazar and Rough Sketch prepared. From the Observation Mahazar and Rough Sketch, it is seen that bathroom is a small place where there is no hook or any facilities for hanging. Further, the inquest report and opinion given by the Panchayathars show that the death was due to self-inflicted injuries Page No.6 of 26 sustained on the head. This is the case of the prosecution till 11.02.2020. After receipt of the Postmortem report by the petitioner, the petitioner approached the 4th respondent Police as well as Rev.Fr.Masilamani and others seeking reason for the death since the Postmortem report shows that her husband died due to Asphyxia by forceful strangulation. Neither Rev.Fr.Masilamani, Kennedy, Ashwin Jerald have stated about the same nor Panchayathars found any such injury on the neck. The investigation was also silent about the same. Only after the petitioner questioned the same, further statements recorded after 11.02.2022, wherein it is projected as though Rev.Fr.Masilamani was informed by Kennedy about the happenings on 13.06.2022 that that petitioner's husband in sitting position with a hand outside the bathroom, committed suicide by using the cloth hanger attached to the door latch. Kennedy removed the iron rope and due to fear, not disclosed the fact then. Rev.Fr.Masilamani informed Kennedy not to reveal the same to anyone since it would affect the name of de-addication centre and other patients might leave the centre. This development in the statement recorded after 11.02.2022 and thereafter, further opinion was sought from the Postmortem Doctor, who opined that the ligature mark found around the neck is due to thin rope or Page No.7 of 26 any kind of substance of that nature.
7.Thus, till 11.12.2022, the 4th respondent Police projected the case as though her husband died due to self inflicted injuries on his head. After the petitioner questioned the same on the basis of the Postmortem report, it has been projected now her husband committed suicide on his own, but no materials collected to confirm the same. The manner in which the suicide is said to have been committed is highly artificial and suspicious. Added to it, there is no investigation despite Postmortem report clearly stating that ligature mark is not in a oblique position, there have been no external injuries to show that the deceased attempted to save himself, no nail marks found, which are normally available. In order to save the de-addiction centre and its inmates, the 4th respondent Police projected a false case, not conducted proper investigation. Further, attempts made to close the case as Further Action Dropped despite the petitioner sending representation to various authorities. Hence, the petitioner filed this petition seeking change of investigation and further, prayed for Further Action Dropped report to be rejected. Page No.8 of 26
8.In support of his contention, the learned counsel for the petitioner produced the RCS notice served to her, Observation Mahazar, Statement of witnesses, Inquest Report, Postmortem Report and Final opinion. Further, he relied on the decision of Hon'ble Apex Court in the case of "Neetu Kumar Nagaich Versus State of Rajasthan and others reported in (2020) 16 Supreme Court Cases 777" and referring to paragraph Nos.12 & 13 submitted that it is the bounden duty of a court of law to uphold the truth and truth means absence of deceit, absence of fraud and in a criminal investigation a real and fair investigation, not an investigation that reveals itself as a sham one.
9.Learned Additional Public Prosecutor appearing for the respondents filed status report, the relevant portion of the same is as follows:- "3. It is submitted that based on the above complaint, a case was registered by G2, Uthiramerur Police Station, Cr. No.408 of 2022, U/s.174 Cr.P.C. on 13.06.2022 at about 12.45 hours by Tr.A.Jayaraman, Sub Inspector of Police and he took up the case for investigation. Page No.9 of 26

¶10Based on the above said reports since it is evident that the deceased committed suicide, so the case in Uthiramerur Police Station Crime No.408 of 2022 has been closed as further action dropped and the report in this regard has been sent to the Judicial Magistrate Court, Uthiramerur. Further, RCS Notice (No.1 of 2023) has been sent to the Complainant by through registered Post."
10.Learned Additional Public Prosecutor submitted that the 4th respondent Police took all steps required to investigate the case. On receipt of information, immediately, the Sub Inspector of Police attached to the 4th respondent Police Station visited the Scene of Occurrence, prepared Observation Mahazar, Rough Sketch in presence of witnesses, enquired the witnesses present in the Scene of Occurrence, thereafter, conducted inquest in presence of Panchayathars, sent the body for Page No.15 of 26 Postmortem. After Postmortem, the body was handed over to the petitioner's family, thereafter, viscera was sent to the Scientific Officer, Forensic Department. During investigation, it was found that the petitioner's husband was with the suicidal tendency, often sustaining self inflicting injuries. From the month of April, 2022, two months prior to the admission in de-addiction centre, the petitioner's husband behaviour was bad and he was an alcoholic. Despite efforts taken by the petitioner, the deceased Sathish habits could not be changed, thereafter only, she admitted him in de-addiction centre, where he committed suicide.
11.He further submitted that after the petitioner raised objection, a questionnaire was sent to the Postmortem Doctor, who opined that it is possible that it might be a reason of suicide. For that reason only, the Further Action Dropped report was prepared and submitted to the Judicial Magistrate, Uthiramerur in R.C.S.No.1 of 2023 and notice served to the petitioner. Thereafter, the case posted for petitioner's appearance on 26.03.2023 to file any protest petition if she intends to do so. The petitioner ought to have approached the Judicial Magistrate, Uthiramerur and not this Court. In view of the above, he prayed for this Page No.16 of 26 petition to be dismissed.
12.This Court considered the rival submissions and perused the materials available on record and also perused the Case Diary in Crime No.408 of 2022.
13.It is not in dispute that the petitioner's husband was an alcoholic person for fifteen years and his condition became worse from the month of April 2022. It is seen that the petitioner's developed hallucination and caused self inflicted injuries by dashing against the door and wall. To save her husband, the petitioner took all possible steps by taking him to various hospitals. On one occasion, the petitioner fell down from his bike and sustained injuries. Thereafter, the petitioner had taken all steps to bring him out from addiction. The petitioner took her husband to Mahatma Gandhi Hospital, Puducherry for treatment, where the petitioner's husband Sathish forced her to get him discharged from the hospital. Thereafter, the petitioner called her sister Keerthi, who was in Bangalore. She gave the address of de-addiction centre, namely, Jesuit Ministry to Alcohol and Drug Dependents, Ongur, Uthiramerur. Page No.17 of 26 Thereafter, on 11.06.2022, the petitioner brought her husband and admitted him in the de-addiction centre. During admission, as per requirement, the petitioner narrated the previous history of her husband and reason for admission. The petitioner stayed there for a day and thereafter, to take care of her two female children, she left to her native. On the next day, the petitioner called the Rev.Fr.Masilamani and Attender Kennedy to know about her husband condition, which was not responded. On 13.06.2022, at about 06.45 a.m., she received a message informing her husband sustained self inflicted injury and admitted in Government Hospital, Uthiramerur. Later, another information received that her husband died due to self inflicted injuries on his head and his body was kept in the Government Hospital, Chengalpet. Immediately, the petitioner rushed to the hospital along with her brother, brother-in-law and others from her village. The 4th respondent Police conducted inquest on the body of the deceased in presence of Panchayathars. After Postmortem, the body was handed over to petitioner and her family. The petitioner had some doubt on her husband's death and the manner in which the de-addiction centre personnel reacted to the situation. Hence, she made all efforts and finally, after five months of the death, she could Page No.18 of 26 get the Postmortem certificate of her husband.
14.On perusal of the Postmortem certificate, it is found that there is ligature mark on the neck of the body and her husband died due to the constructive force around the neck. This constructive force was self inflicted or by external force, is the moot question, which is the need of the investigation.
15.In this case, the Investigating officer/4th respondent Police for the reasons best known, not taken proper steps to find out the reason for the cause of the death. On perusal of the Case Diary, it is seen that on
13.06.2022, after registration of the case, the 4th respondent went to the de-addiction centre, prepared Observation Mahazar and Rough Sketch in presence of witnesses. From the Observation Mahazar, nothing could be found out, no physical features recorded height, length and breadth of the bathroom and no recordings with regard to presence of blood stains in the wall. Page No.19 of 26
16.From the statement of inmates of de-addiction centre namely Rev.Fr.Masilamani, Kennedy and Ashwin Jerald, it is seen that it was Kennedy who first seen the deceased Sathish in a sitting position. For what reason, the deceased was moved from that position and laid in the cot, not known. Rev.Fr.Masilamani was informed about the incident, immediately, he took the deceased to Government Hospital, Uthiramerur. In the hospital, they have not disclosed the real facts. Thereafter, the Investigating Officer recorded the statements of witnesses, conducted inquest on the body of the deceased and sent the body for Postmortem. Till the objections raised by the petitioner, the case has been projected that the deceased had self inflicted injury on his head and that is the cause for the death. In this case, the ligature marks not noted and recorded in the Inquest Report or in any of the statement of witnesses. The Postmortem Doctor opined that the death is due to Asphyxia and due to constructive force around the neck which has been failed to be noted and recorded till 11.02.2022. After the petitioner doubted the investigation and raised objections based on the Postmortem certificate, further statement of witnesses namely Rev.Fr.Masilamani, Kennedy and Ashwin Jerald were recorded. From the statements, it is seen that Page No.20 of 26 Rev.Fr.Masilamani was aware of the reason for the death even on
13.06.2022 and the same disclosed to him by Kennedy and to Ashwin Jerald, which is clearly a suppression of fact and concealment. On the contrary, it was projected as though strangulation was due to iron cloth hanger which was removed and thrown away. The Postmortem Doctor opined that strangulation might be use of thread. There is difference in the mode of strangulation. Further, there is no oblique ligature marked showing that it might be handing. The clear opinion of the Postmortem Doctor is that there was no nail mark or any injury which are normally available in the case of suicide.
17.On perusal of the Case Diary, it shows that on 13.06.2022, the statement of the witnesses from the de-addiction centre, witnesses for Observation Mahazar, Rough Sketch, Inquest and the petitioner, her family members were recorded. On 14.06.2022, the Postmortem report is said to have been received and viscera collected, but the viscera has been sent only on 15.07.2022. Till 01.08.2022 the Sub Inspector of Police conducted investigation and thereafter, the Inspector rides to the Doctor and Scientific Officer of the Forensic Department and obtained final Page No.21 of 26 opinion on 30.08.2022 and thereafter, on 02.11.2022, summons to the brother-in-law and co-brother of the petitioner were sent. On
11.02.2022, the statement of the Rev.Fr.Masilamani, Kennedy and Ashwin Jerald have been recorded, which are contradictory version. On
11.02.2022, they gave statement that the death of the deceased was due to hanging. From the Observation Mahazar and photographs produced by the petitioner, it is seen that hanging as projected is not possible.
18.In such circumstances, it is clear that Asphyxia due to constructive force around the neck might not be self inflicted, it can be by external force. Who caused external force, it is for the Investigating Officer to find out from the materials collected and statements recorded during investigation. Thus, in this case, the investigation not proceeded in the manner it ought to be done.
19.On 15.01.2023, the Investigating Officer/4th respondent Police has recorded the reason given by him for closing the FIR as Further Action Dropped, is as follows: Page No.22 of 26 "X';Th; fpuhkj;jpy; Jesuit Ministry to Alcohol and Drug Dependents Centre-y; rpfpr;irf;F nrh;j;jjhy; kdtpuj;jpapy; ,Ue;j rjPc&; ghj;U:k; fjtpd; jhH;nghLk; ,Uk;g[ bfhf;fpapy; jdf;F jhnd mkh;e;j epiyapy; Jzp fhaitf;Fk; ,d;rnyl;lh;

20.On such finding, Further Action in Crime No.408 of 2022 dropped and R.C.S.No.1 of 2023, dated 18.01.2023 made ready. It is strange to see that a person can commit suicide by hanging in a sitting position.
21.Thus, from the above discussions, this Court finds that the investigation conducted by the 4th respondent Police is not proper. Hence, the Further Action Dropped report in Crime No.408 of 2022, dated 15.01.2023 is hereby rejected and, is set aside.
22.The learned Judicial Magistrate, Uthiramerur to return the Further Action Dropped report in Crime No.408 of 2022, dated Page No.23 of 26
15.01.2022 to the 4th respondent Police. After receiving the same, the 4th respondent Police shall place the entire Case Diary in Crime No.408 of 2022 to the Superintendent of Police, Kancheepuram/3rd respondent.
23.The Superintendent of Police, Kancheepuram/3rd respondent shall nominate an Investigating Officer not less than the rank of Deputy Superintendent of Police to conduct further investigation. The Superintendent of Police, Kancheepuram/3rd respondent to monitor the investigation till filing of the final report.
24.The further investigation in Crime No.408 of 2022 to be completed and final report to be filed without delay, preferably, within a period of four months from the date of receipt of a copy of this order.
26.With the above directions, this Criminal Original Petition is disposed of.
