Judgment

ORDER The prayer in this Criminal Original Petition is to transfer the investigation from the respondent police to any other investigating agency with reference to Crime No.322 of 2022.

¶2The gist of allegations in this case is that the petitioner's house was broken open, and 20 sovereigns of gold, 500 grams of silver and cash of Rs.25,000/- were stolen from the petitioner's house. Inspite of the complaint being given in the year 2022, no action has been taken till date to recover the valuables. Hence, this petition seeks a transfer the investigation to any other investigating agency.

¶3When the matter came up for hearing, the learned Government Advocate (Criminal Side) would submit that the respondents/police made their best efforts to trace and recover the valuables. However, the valuables could not be recovered and as such the final report is now being filed and a due RCS notice will be served on the complainant. Page3 of 5

¶4In view thereof, this Criminal Original Petition is disposed of, on the following terms:

(i) The RCS notice shall be served on the complainant within 10 days from the date of receipt of the web copy of this order.

(ii) It will be open for the complainant to file a protest petition before the Trial Court before which the final report is being filed.

¶5With the above observations, this Criminal Original Petition is disposed of. 09-07-2026 jas Page4 of 5 To
