Judgment
ORDER The petitioner, who was arrested and remanded to judicial custody on
12.06.2026 for the alleged offences under Sections 318(4), 316(2), 336(3), 340(2) of BNS, 2023 and Section 66C, 66D of the Information Technology Page2 of 6 Act, 2000 in Crime No.58 of 2026 on the file of the respondent police, seeks bail.
¶2The allegation against the petitioner is that he is alleged to have misappropriated a sum of Rs.16,95,000/- which had been remitted to the Government account through the E-seva centre run by him. Hence, the present petition has been filed by the petitioner for seeking bail.
¶3The learned counsel for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner was arrested and remanded to judicial custody since 12.06.2026 and is willing to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner.
¶4The learned Government Advocate (Crl.Side) strongly opposed the bail application and submitted that, though the petitioner has no criminal antecedents, the allegation against him is that he created fake receipts and thereby caused a loss of Rs.16,95,000/- to the Government exchequer. He further submitted that the allegations are serious, as they involve misappropriation of public funds. Hence, he opposed the grant of bail to the Petitioner. Page3 of 6
¶5I have given my anxious consideration to either side submissions and perused the materials available on record.
¶6Considering the facts and circumstances of the case, the fact that the petitioner has been in incarceration since 12.06.2026, that the petitioner has no criminal antecedents, that he has not been taken into police custody by the respondent police so far, and also taking into consideration the voluntary submission made by the learned counsel for the petitioner, this Court is of the firm view that the petitioner's further custodial interrogation is not required for the purpose of investigation. At this juncture, the learned counsel for the petitioner submitted that, without prejudice to the petitioner's defense and contentions, he is ready and willing to deposit an amount of Rs.2,50,000/- to the credit of the concerned Crime Number. Accordingly, this Court is inclined to grant bail to the petitioner, subject to certain conditions.
¶7Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned Principal District and Sessions Judge, Chengalpattu, and on further conditions that: Page4 of 6 [i] The petitioner is ordered to be enlarged on bail on condition that the petitioner shall deposit a sum of Rs.2,50,000/- (Rupees Two Lakhs Fifty Thousand only) to the credit of Crime No.58 of 2026 on the file of the learned Principal District and Sessions Judge, Chengalpattu within a period of four weeks from the date of receipt of a copy of this order.
(ii) On such deposit being made, the Trial Court shall redeposit the said amount in a Fixed Deposit Account, in any one of the Nationalised Banks, renewable thereafter periodically. The disbursal of this amount shall be decided at the culmination of the Criminal Original Petition.
(iii) the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [iv] the petitioner shall report before the respondent police daily at 10.30 a.m., until further orders; [v] the petitioner shall not abscond either during investigation or trial; [vi] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [vii] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with Page5 of 6 law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [viii] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 10-07-2026 DRL Note:
