ORDER The petitioner, who was arrested and remanded to judicial custody on
20.06.2026 for the alleged offences under Sections 7 and 8 of the Protection of Children from Sexual Offences Act, 2012 and Section 351 (2) of BNSS, 2023, in Crime No.320 of 2026 on the file of the respondent police, seeks bail.
¶2The case of the prosecution is that the petitioner is a School Teacher at Bharathidasanar School, where the defacto-complainant is studying in the XI Page2 of 6 Standard. It is alleged that the petitioner induced the defacto-complainant to have a homosexual relationship with him and threatened him. Hence the case.
3.The learned counsel for the petitioner submitted that the petitioner is innocent and has been in custody since 20.06.2026. He further submitted that the petitioner is a Chemistry Teacher who had reprimanded the victim for using a cool lip (tobacco), after which the present case was registered. He further stated that the occurrence took place on 17.06.2026 and the First Information Report was registered on 20.06.2026. Hence, he prays to grant bail to the petitioner.
4.At this juncture, the learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner, being a school teacher, had misbehaved with the student. Hence, he strongly opposed for grant of bail to the petitioner.
¶5I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.
6.Though certain allegations of sexual assault were made against the petitioner, considering the fact that the petitioner is a school teacher, and he has been incarcerated since 20.06.2026, this Court is of the firm view that his Page3 of 6 further custody is not required for the purpose of investigation. Hence, this Court is inclined to grant bail to the petitioner with certain conditions.
¶7Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate No.I, Arakonam, and subject to the following conditions: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall stay at Coimbatore district and appear before the Singanallur Police station daily at
10.30 a.m. for a period of fifteen days; thereafter as and when required for interrogation before the respondent Police; [c]Unless the completion of the trial, the School Management is directed not to post the petitioner to the school where the victim is studying; [d] the petitioner shall not abscond either during investigation or trial; [e] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [f] on breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to take appropriate Page4 of 6 action against the petitioner in accordance with law as if the conditions had been imposed and the petitioner released on bail by the learned Magistrate/Trial Court itself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [g] if the petitioner thereafter abscond, a fresh FIR may be registered under Section 269 of the Bharatiya Nyaya Sanhita, 2023. 10-07-2026 ep Note:
