Judgment

ORDER The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 294(b), 115(2), 351(3), 74 of BNS Act (Sec 294(b), 323, 354 and 506(ii) of IPC) in Crime No.234 of 2026, Page2 of 5 seek anticipatory bail.

¶2The case of the prosecution is that the petitioners and the defacto complainant are neighbours. During construction of the house of the 2nd petitioner, there was a wordy quarrel between the petitioners and the defacto complainant, which escalated into violence. Hence, the case.

¶3The learned counsel for the petitioners would submit that the petitioners are innocent and they have nothing to do with the alleged offence and a false case has been foisted. He would submit that a counter case has been registered against the defacto complainant. He would further submit that the petitioners are ready to co-operate for investigation. Hence, he prays for the grant of anticipatory bail.

¶4Though the learned Government Advocate (Crl. Side) would oppose the anticipatory bail application by reiterating the prosecution case, would fairly submit that the injured was discharged from the hospital and that the petitioners have no criminal antecedents.

¶5Considering the facts and circumstances of the case and also considering the fact that the injured was discharged from the hospital and that Page3 of 5 the petitioners have no criminal antecedents, this Court is of the firm view that the custodial interrogation of the petitioners is not required. Hence this Court is inclined to grant anticipatory bail to the petitioners with certain conditions.

¶6Accordingly, the petitioners are ordered to be released on anticipatory bail in the event of arrest or on their appearance, within a period of fifteen (15) days from the date on which the order copy is made ready, before the Judicial Magistrate, Ambur, on condition that the petitioners shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties, each for a like sum, to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned, failing which, the petition for anticipatory bail shall stand dismissed and on further conditions that: [a] If the petitioners fails to surrender before the concerned learned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled; [b] The sureties shall affix their photographs and left thumb impression in the application for suretyship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identity proofs to ensure their identity; [c] the 1st , 3rd , and 6th petitioners shall report before the respondent police daily at 10.30 a.m., for a period two weeks and thereafter as and when required for the interrogation and the 2nd, 4th and 5th petitioners shall report before the respondent police as and when required for the interrogation. Page4 of 5 [d] the petitioners shall not tamper with evidence or witness either during investigation or trial; [e] the petitioners shall not abscond either during investigation or trial. [f] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the Petitioners in accordance with law as if the conditions have been imposed and the Petitioners released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560]; [g] If the petitioners thereafter absconds, a fresh FIR can be registered under Section 269 of BNS.
