Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

24.05.2026 for the alleged offences under Section 194 of BNSS and subsequently altered to Sections 103(1), 238 and 61(1) of the Bharatiya Nyaya Sanhita, 2023, in Crime No.190 of 2026 on the file of the respondent police, seeks bail.

¶2It is the case of the prosecution that, while the petitioner and the deceased were consuming alcohol, a wordy quarrel arose, which escalated into an altercation, whereby the petitioner attacked the deceased using a knife, thereby causing his death on the spot. Hence, the case.

¶3The learned counsel appearing for the petitioner would submit that the petitioner is innocent and has been falsely implicated in this case. He would further submit that the petitioner has been in custody since 24.05.2026 and that, in any event, his further custody is not required for the purpose of investigation. Hence, he prayed for grant of bail.

¶4The learned Government Advocate (Crl. Side) appearing for the respondent police, while opposing the grant of bail, reiterated the prosecution case and, on instructions, submitted that the manner in which the petitioner assaulted the deceased clearly demonstrates the severity and gruesomeness of the offence. He would further submit that, after causing as many as 25 stab injuries to the deceased, the petitioner dumped the body into the well situated in the defacto complainant's farmhouse. It was further submitted that, if the petitioner is enlarged on bail, there is every possibility of his tampering with witnesses.

¶5Though the entire incident is stated to have occurred in the course of consumption of alcohol, the manner in which the petitioner assaulted the deceased by inflicting as many as 25 stab injuries and thereafter dumped the body into the well clearly demonstrates the gravity of the allegations levelled against the petitioner and the gruesome nature of the murder. In such circumstances, this Court is of the view that, if the petitioner is enlarged on bail, the same would shock the conscience of society. Hence, this Court is of the view that it would not be appropriate to grant bail to the petitioner at this stage.

6.Accordingly, the Criminal Original Petition is dismissed.
