Judgment
ORDER (Order of the Court was made by P.VELMURUGAN, J.) This Writ Petition has been filed seeking to quash the proceedings dated 24.06.2026 issued under Section 7 of the Tamilnadu Land Encroachment Act, 1905 (in short "the Act"), by the fourth respondent. Learned counsel for the writ petitioner would submit that subsequent to the impugned proceedings dated 24.06.2026, the authority has passed the order under Section 6 of the Act and hence he filed a miscellaneous petition to amend the prayer challenging the order passed under Section 6 of the Act, which is yet to be numbered. The writ petitioner challenged the impugned proceedings issued by the fourth respondent under Section 7 of the Act and according to the learned counsel for the writ petitioner, subsequent to the show cause notice issued under Section 7 of the Act, the authority has passed order under Section 6 of the Act and he filed miscellaneous petition to amend the prayer to the effect of challenging the order under Section 6 of the Act. Assuming that the said miscellaneous petition seeking amendment of prayer is numbered, no purpose would be served, since as against the order passed under Section 6 of the Act, there is efficacious appeal remedy available for the petitioner before the District Collector under Section 10 of the Act. Hence this Court is not inclined to grant any relief as sought for by the petitioner and accordingly the Writ Petition shall stand dismissed. However, the petitioner is at liberty to workout his remedy in the manner known to law. Consequently connected miscellaneous petitions stand closed. No costs. [P.V. J.,] [K.G.T. J.,]
