Judgment

O R D E R This writ petition has been filed for direction directing the respondents 1-4 to consider the representation dated 11.06.2026 seeking removal of the movable properties as described in Schedule A owned by the accused.

2.The petitioner owned a residential apartment bearing Flat No.1001, Tower II, Ceebros One74, situated at No.174, Adyar Seaface, M.R.C. Nagar, Raja Annamalaipuram, Chennai – 600 028. It was rented out to the fifth respondent. Thereafter, the fifth respondent also committed default in payment of rents and as such the petitioner was also taking steps to vacate the fifth respondent from the premises. While being so, the fifth respondent was involved in serious criminal offence in Crime No.82 of 2025 on the file of the second respondent for the allegation of large scale financial fraud. In pursuant to the registration of FIR, the second respondent has seized the cars owned by the fifth respondent which are parked in the car parking meant for the said flat and kept the locker inside the bedroom of the flat. Though the second respondent seized those properties, all are kept in the petitioner's premises and as such the petitioner could not able to let out the premises to other parties.

3.On instruments, the learned Counsel for Government of Tamil Nadu (Criminal Side) submits that though those properties were seized by the second respondent, on the application filed by the fifth respondent, two cars bearing Registration Nos.TN-07-DK-0777 and TN-07-DL-0777 were ordered to be released by this Court in Crl.R.C.Nos.356 and 401 of 2026 by an order dated 01.06.2026. However, so far, the fifth respondent failed to produce surety inorder to get back the cars. He further submits that the locker owned by the fifth respondent is very big one and without demolishing some permanent wall in the superstructure, it cannot be removed. That apart, the locker cannot be removed without breaking the same.

4.Though the fifth respondent did not take any steps to get back the cars, all the cars which are seized by the second respondent are parked in the car parking meant for the flat owned by the petitioner. Therefore, if anything happens to the cars, the second respondent is answerable for the same.

5.In view of the above, the second respondent is directed to remove the cars which were seized from the fifth respondent [totally three cars] by using any other method with the guidance of the dealer of the respective cars, from the petitioner's premises and bring the cars to the custody of the second respondent. Insofar as the locker is concerned, the second respondent is directed to remove the locker kept by the fifth respondent in the premises owned by the petitioner by break open and taking inventories in respect of the things available in the locker in the presence of jurisdictional Thasildar, within a period of three weeks from the date of receipt of a copy of this order.

6.With the above direction, the writ petition is disposed of.
