Judgment

ORDER This petition has been filed to modify the condition imposed in para Page2 of 4 No.7(c) in Crl.O.P.No.8600 of 2026, dated 07-04-2026.

¶2The learned counsel for the petitioner submitted that the 1st petitioner is ready and willing to comply with the conditions imposed by the Court in Crl.OP.No.8600 of 2026, dated 07-04-2026. However, in para NO.7(c) of the said order, it is stated that 'The petitioners are directed to make a non refundable deposit of Rs.1,60,000/- (Rupees One Lakh and Sixty Thousand Only) totally (for all the three petitioner) directly to the credit of "Tamil Nadu State Legal Services Authority, High Court Campus, Chennai", without prejudice to the right of the defence before the Trial Court and the receipt shall be produced at the time of executing the bond",

2.1. The learned counsel further submitted that if the word 'each' is specifically mentioned in the order, it would enable the petitioners to clearly understand the liability and comply with the condition without ambiguity. Therefore he seeks modification of the said condition.

¶3Considering the said submission made by the learned counsel for the petitioner and on a perusal of paragraph No.7(c) of the order passed in Crl.O.P.No.8600 of 2026, dated 07-04-2026, this court is of the view that the condition requires modification to avoid any ambiguity in its implementation. Accordingly, Paragraph No.7(c) is modified to the effect that "'7 (c).The Page3 of 4 petitioners are directed to make a non refundable deposit of Rs.53,333.00/- (Rupees Fifty Three Thousand three hundred and thirty three only ) each, [Rs.160000.00 /3= Rs.53333.00] directly to the credit of "Tamil Nadu State Legal Services Authority, High Court Campus, Chennai", without prejudice to the right of the defence before the Trial Court and the receipt shall be produced at the time of executing the bond", The other conditions remain unaltered.

¶4Accordingly, the criminal miscellaneous petition is ordered. 22-07-2026 JRS To
