¶2Learned counsel would point out that an identical issue has been considered by this Court on 03.10.2023 at the time of admission in W.P Nos.28707 and 28712 of 2023, wherein the following order was passed: Mr.D.R.Arunkumar, learned Standing Counsel accepts notice for the respondents and seeks some time to obtain instructions and file a counter.

¶2In similar matters, my predecessor has passed a detailed order in W.P No.22069 of 2023 on 26.07.2023 and since both, the learned counsel for the petitioners and the learned Standing Counsel for the respondents would concur on the position that those directions are to continue in the present matters as well, the following directions are issued: a) Respondents 2 and 3 are directed to give adjustment of wind energy generated from the petitioner's windmill from March/2023 onwards. b) The respondent are directed not to stop wheeling the energy which the petitioners generate.

¶3As far as the direction in (c) is concerned, one development post order dated

26.07.2023, is that Tangedco had approached the Hon'ble Supreme Court seeking interim directions and in SLP bearing Nos.16302-16338 of 2023, the Hon'ble Apex Court noted under order dated 25.08.2023 that Writ Appeals as against the order of the learned single Judge in W.P Nos.16104 of 2021 and batch dated 27.01.2022 had already been fixed for hearing before the First Bench of this Court on 27.09.2023 and gave liberty to the Tangedco to move the First Bench for vacating the interim order passed on 24.04.2023 by the First Bench. It is thus that the First Bench has passed an order on 27.09.2023.

¶4Having regard to that order as well, the direction in clause (c) would now read as under:

(c) The petitioners banking facility for one year in respect of old machines commissioned prior to 2018 and will also maintain statement of accounts online as to how the energy is consumed.

¶5Since the issue involved in these Writ Petitions are pending before the First Bench of this Court, Registry is directed to tag these Writ Petitions along with W.A.Nos.2325 of 2022 batch after obtaining orders from the Hon'ble Chief Justice.

¶3In the light of the complete identity in facts and legal position, the above order dated

03.10.2023 is taken to have been passed in the present Writ Petitions as well.
