Judgment

ORDER (Order of the Court was made by Sunder Mohan J.) The granddaughter of the convict prisoner-Rangan @ Chinnathambi [PID No.21311], S/o. Sadaiyan, aged 75 years, who is confined at Central Prison, Coimbatore, has filed this writ petition challenging the impugned order dated 12.03.2026, by which the request for Ordinary Leave to the convict was denied.

¶2The convict had sent the representation seeking 28 days Ordinary Leave on the ground that his wife i.e., petitioner's grandmother, was suffering from several ailments and that the convict is required to make arrangements for the livelihood of the family and to repair the house. The Probation Officer found the reasons to be true and recommended leave. However, the jurisdictional police had objected to grant of leave saying that if he is released on leave, there will be a law and order disturbance since the sisters of the convict have a property dispute with the convict.

¶3The learned counsel for the petitioner however would submit that the report of the police is baseless and that though there is a partition suit, the convict was granted leave thrice by orders of this Court in W.P.Nos.33708/2024 dated 12.11.2024, WP No.584 of 2025 dated

10.01.2025 and WP No.780 of 2025 dated 07.10.2025.

¶4The learned counsel for Government of Tamil Nadu (Criminal Side), appearing for the respondents fairly submitted that the Probation Officer had found the reasons to be true and also referred to a partition suit pending between the convict and his sisters.

¶5We have carefully considered the rival submissions. We find that this Court had earlier granted leave without escort by the orders referred above and admittedly, no untoward incident had been reported. It is not the case of the police that there is change in circumstances after the convict was last granted leave. The Probation Officer has found the reasons for leave to be true and has recommended leave. The convict is otherwise eligible for leave since according to the respondent he has been in confinement for nearly 13 years and 9 months. Therefore, we are inclined to set aside the impugned order and grant Ordinary leave for 28 days to the convict.

¶6Accordingly, this Writ Petition is allowed and the impugned order is set aside. The convict prisoner is granted Ordinary Leave without escort for a period of 28 days commencing from 20.07.2026 on the following conditions:

(i) The respondents are directed to release the convict viz., Rangan @ Chinnathambi S/o. Sadaiyan, aged 75 years, Convict PID No.21311 confined at Central Prison, Coimbatore, on ordinary leave without escort, for a period of twenty-eight (28) days i.e., from 20.07.2026 to 16.08.2026.

(ii)The convict shall be released on 20.07.2026 at 10.00 A.M. and is directed to surrender before the Superintendent of Prisons, Central Prison, Coimbatore, on 17.08.2026 before 10.00 A.M.

(iii) The convict shall report before the jurisdictional police i.e., Avinashi Police Station, daily at 10.30 a.m., during the period of leave, except the date of release and surrender.

(iv)During the leave period, the Convict Prisoner shall abide by all the conditions prescribed in the Jail Manual. (A.S.M.,J.) (S.M.,J.) 17-07-2026 Index: Yes/No Speaking/Non-speaking order Issue order copy today. ars
