Judgment

ORDER The petitioner apprehends arrest for the alleged offence under Sections 191 (2), 191 (3), 126 (2) and 103 (1) of BNS, 2023, in Crime No.159 of 2026 on the file of the respondent police seeks anticipatory bail.

¶2The case of the prosecution is that there was previous enmity between the petitioner, the other accused persons and the son of the defacto-complainant. It is alleged that on 21.04.2026, at about 12.30 to 16.30 hours, near Barath Page2 of 4 Petrol Bunk, Central Theatre, London Pet, Krishnagiri, one Sahul Ameed (A1) stabbed the son of the defacto-complainant with a knife on his chest and back and attacked him with a beer bottle on his head. It is further alleged that the other accused persons held the son of the defacto-complainant from behind. Consequently, the son of the defacto-complainant succumbed to his injuries. Hence, the complaint.

¶3The learned counsel for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the co-accused has been already been released on bail. He stated that the petitioner is ready to abide by any conditions that may be imposed by this Court and that he is ready to cooperate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner.

4.Per contra, the learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case. He submitted that the overt act attributed to the petitioner is that while A1 attacked the deceased, this petitioner restrained the deceased and accompanied A1. Hence, he strongly opposed to grant anticipatory bail to the petitioner.

¶5I have given my anxious consideration to either side submissions. Page3 of 4

6.Considering the submissions of the learned counsel for the Government Advocate (Criminal side) and taking into account the serious nature of the allegations against the petitioner, this Court is of the view that, the petitioner does not deserve anticipatory bail. Hence, this Court is not inclined to enlarge the petitioner on anticipatory bail.

¶7Accordingly, this Criminal Original Petition is dismissed. 27-07-2026 (2/2) Index: Yes/No Speaking/Non-speaking order EP To
