Judgment

ORDER The present writ petition has been filed seeking issuance of a writ of mandamus directing respondents 3 and 4 to consider and dispose of the petitioner's representation dated 02.07.2025 and to settle a sum of Rs.52.60 lakhs claimed towards charges for the Detailed Project Report (DPR) and Ground Levelling Report allegedly prepared and submitted by the petitioner.

¶1The petitioner's case is that, pursuant to the oral instructions of the Municipal Commissioner, Ulundurpet Municipality, he prepared and submitted a Detailed Project Report identifying measures for augmenting drinking water sources with a view to securing funds under the Kalaignar Nagarpura Mempattu Thittam. According to the petitioner, the report, along with the estimated cost, was submitted to the Municipal Commissioner and was approved by the Municipal Commissioner, the Municipal Engineer and the Overseer.

¶2Per contra, learned counsel appearing for the Municipality submitted that the work of preparing the Detailed Project Report was never entrusted to the petitioner. It was submitted that a tender notification dated 06.05.2025 was issued inviting bids for the said work, pursuant to which the contract was awarded to M/s. R.K. Constructions, Mangalampettai, Virudhachalam, being the lowest bidder. It was further submitted that the successful bidder has completed a substantial portion of the work and has Page3 of 5 been paid in accordance with the terms of the contract. Therefore, in the absence of any contractual relationship between the petitioner and the respondents, the petitioner's claim for payment on the premise that he had prepared the Detailed Project Report is wholly untenable.

¶3In the light of the rival submissions, this Court is not inclined to adjudicate upon the disputed questions of fact arising between the parties in exercise of its jurisdiction under Article 226 of the Constitution of India. However, having regard to the facts and circumstances of the case, and without expressing any opinion on the merits of the rival claims, this writ petition is disposed of with a direction to the third respondent to consider and dispose of the petitioner's representation dated 02.07.2025, on its own merits and in accordance with law, after affording the petitioner an opportunity of hearing, within a period of six weeks from the date of receipt of a copy of this order.

¶4There shall be no order as to costs. Consequently, the connected miscellaneous petition is closed. 07-07-2026 Index: Yes/No Speaking/Non-speaking order ssk Page4 of 5 To
