Judgment

Order This Writ Petition has been filed to direct the first respondent to consider the petitioner's representation dated 25.09.2025 to dispose of the statutory appeal dated 22.10.2023, together with the petition for condonation of delay.

¶2Petitioner joined the third respondent school on 12.06.2012. By an order dated 25.09.2015, third respondent confirmed her appointment with effect from 10.06.2015 and extended all attendant benefits. Third respondent by proceedings dated 13.08.2021, terminated the petitioner from service. Aggrieved by the said order of termination, the petitioner filed an appeal on

16.11.2022 before the second respondent. By an order dated 28.08.2023, second respondent dismissed the appeal on the ground that the financial hardship caused due to Covid-19 pandemic justified the termination. Thereafter, Page3 of 6 petitioner filed a statutory appeal before the first respondent along with a petition to condone the delay. Since no action forthcoming from the first respondent, petitioner submitted a representation to the first respondent on

04.03.2024, seeking early disposal of the appeal. As the first respondent failed to dispose of the statutory appeal, petitioner filed W.P.No.30430 of 2024 seeking a direction to first respondent to dispose of the appeal. This Court by an order dated 18.10.2024 directed the first respondent to consider the petitioner's appeal on merits and pass orders within eight weeks. Despite the directions of this Court, first respondent failed to dispose of the appeal within the stipulated time. Hence, petitioner submitted a further representation dated 25.09.2025 enclosing a copy of the order passed in W.P.No.30430 of 2024 and requested compliance. However, first respondent did not take any action on the representation of the petitioner. Hence, petitioner is before this Court.

¶3At the outset, learned Government Counsel for the respondents 1 and 2 would submit that first respondent would consider the representation dated

25.09.2025 and dispose of appeal dated 22.10.2023 and pass appropriate orders within a period of two weeks. The same was agreed to by the learned counsel for petitioner.

¶4In view of the same, taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, Page4 of 6 there shall be a direction to the first respondent to consider the representation dated 25.09.2025 and dispose of appeal submitted by the petitioner dated

22.10.2023 on its own merits and pass appropriate orders in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to petitioner and any other interested persons within a period of two weeks from today. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
