¶2It is averred in the affidavit submitted by the petitioner that she is the absolute owner and is in lawful possession and enjoyment of the lands comprised in Survey No.528/1 and 528/2 situated at Eruppali Village, Edapadi Taluk and the said lands were originally purchased by the petitioner's husband Page3 of 5 under registered sale deeds. 31.03.2009 and after the demise of petitioner's husband, the revenue records including patta stand mutated in the petitioner's name. Since there are complaints made against the transfer of property for the subject lands on the alleged ground that it is belonging to the temple, the jurisdictional Sub Registrar to register documents pertaining to the lands is stated to conduct enquiry, hence, this writ petition has been filed for the appropriate relief. The learned counsel further submits that unless and otherwise order is obtained from the court, the 2nd respondent would not receive and register the document.

¶3Learned counsel for the respondents submits that no such condition is imposed by the 2nd respondent so far, therefore, if the writ petitioner presents the document, the same will be received and if it is otherwise in order, the same will be registered and if necessary, enquiry will be conducted by giving notice to R3.

¶4Heard both sides counsel submissions. Considering the facts and circumstances of the case, the petitioner is directed to present the document for registration. If the petitioner present any such document, the 2nd respondent-Sub Registrar is directed to receive the said document and if necessary, after issuing notice to all the parties concerned and by conducting enquiry, register the Page4 of 5 document, in accordance with law.
