Judgment

ORDER This Writ Petition has been filed for the following reliefs:- "Directing the respondents to consider and pass orders on the representation dated 13.01.2026 made by the petitioner for grant of all retirement and pensionary benefits by taking into consideration the actual date of appointment as 01.10.2001 and not from 01.09.2011 and grant such other further relief as this Honble Court may deem fit in the circumstances of the case."

¶2The petitioner was appointed as a Lab Attender in the Government Thoothukudi Medical College pursuant to G.O.(Ms.) No.87, Health and Family Welfare Department, dated 04.03.1999. Seeking regularisation of service, the petitioner had approached this Court, which directed the respondents to regularise his service from the date of his initial appointment. As the said direction was not complied with, the petitioner had initiated contempt proceedings in C.P.(MD) No.727 of 2015.

¶3Thereafter, the Government had issued G.O.(Ms.) No.325, Health and Family Welfare (C1) Department, dated 11.09.2017, regularising the petitioner's Page3 of 5 services in the cadre of Attendant, a post falling under the Tamil Nadu Basic Service, with effect from 01.09.2011. However, contrary to the directions of this Court, the respondents did not regularise the petitioner's service from the date of his initial appointment. Consequently, the petitioner was denied service and monetary benefits for the period prior to 01.09.2011.

¶4The petitioner had superannuated from service on 30.04.2025. As his services were regularised only from 01.09.2011, he was brought under the Contributory Pension Scheme (New Pension Scheme) and was denied pensionary and other retirement benefits. According to the petitioner, had his services been regularised from 01.10.2001, he would have completed the requisite qualifying service of 23 years and 7 months and become entitled to pension and other retirement benefits.

¶5In these circumstances, the petitioner had submitted a representation dated 13.01.2026, seeking regularisation of service from the initial date of appointment and consequential service and retirement benefit. As no orders were passed on the said representation, the petitioner has filed the present writ petition.

¶6Heard the learned counsel on either side and perused the records. By consent of the learned counsel on either side, the matter was taken up for final Page4 of 5 disposal at the stage of admission.

¶7Considering the relief sought by the petitioner and in the absence of any serious objection from the learned counsel appearing for the respondents, this Court, without going into the merits of the case, directs the 1st respondent to consider and pass appropriate orders on the petitioner's representation dated

13.01.2026, on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

¶8Accordingly, the writ petition is disposed of. No costs. 17-07-2026 Index: Yes/No Speaking/Non-speaking order SHR To
