Temojy v. Gnanambal

ORDER This Civil Revision Petition has been filed, seeking for a limited relief.

¶2The petitioners are the plaintiffs in the suit O.S. No. 165 of 2024 pending on the file of the III Additional District Court, Puducherry. The respondents are the defendants in the said suit.

¶3The suit has been filed for partition and separate possession. According to the petitioners, repeatedly, the suit is getting adjourned for filing of written statement by the defendants 5 and 6.

¶4As seen from the cause title of the plaint, all the parties are senior citizens. No prejudice will be caused to any of the parties if a direction is issued to the trial Court to dispose of the suit within a time frame to be fixed by the Court.

¶5Since no adverse orders are passed against the respondents in this Civil Revision Petition, notice to the respondents is dispensed with by this Court.

¶6For the foregoing reasons, this Court directs the III Additional District Court, Puducherry, to dispose of the suit O.S. No. 165 of 2024 after directing the defendants 5 and 6 to file their written statement within a time frame to be fixed by the trial Court and after framing of issues and conducting trial, within a period of eight months from the date of receipt of a copy of this order.

¶7Accordingly, this civil revision petition is disposed of. No Costs.
