Judgment
ORDER By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.
¶2The present writ petition is filed praying for a writ of Mandamus, directing the respondents 1 and 2 to issue a Legal Heir Certificate in respect of the petitioner's deceased mother, based on the petitioner's online application No. TN-720240730482 and his representation dated 23.06.2026.
¶3At the outset, learned counsel for the respondents would submit that the issuance of the Legal Heir Certificate requires the petitioner to furnish a No Objection Certificate, which has not been submitted by the petitioner, thereby resulting in the non-issuance of the legal heir certificate. Learned counsel would further submit that the petitioner's presence may be required before the second respondent. On such appearance, the petitioner's request for issuance of the legal heir certificate shall be considered and appropriate orders shall be passed, after issuing notice to petitioner and any other interested parties in accordance with law. Agreed to by the learned counsel for the petitioner. Page3 of 4
¶4In view of the submissions made by the learned counsel on either side, this Court is inclined to dispose of the writ petition by directing the petitioner to appear before the second respondent on 29.07.2026 at 11.00 a.m. On such appearance and furnishing of the No Objection Certificate, the first respondent shall consider the petitioner's request for issuance of the Legal Heir Certificate and pass appropriate orders, after issuing notice to the petitioner and any other interested parties, in accordance with law. It is made clear that this Court has not expressed any views with regard to the merits of the petitioner's request and it is open to the concerned respondents to consider the petitioner's request on its own merits and in accordance with law.
¶5With the above directions, this writ petition is disposed of. No costs. 24-07-2026 SHK TO
