ORDER This writ petition has been filed seeking a writ of mandamus directing the respondent to consider the petitioner's representation dated 06.09.2021 to include the Wakf properties situated at Udayendiram Village in Survey Nos.516/2 and 520/2 measuring a total extent of 2.94 acres together with well and coconut trees in the Wakf Proforma of Neeligottai Mosque and Burial Ground wakf and issue an updated original proforma to the petitioner.
¶2The learned counsel for the petitioner would submit that the petitioner, who is a septuagenarian and Muthawalli of Neeligottai Mosque and Burial Ground Wakf, submitted a representation dated 06.09.2021 to the respondent seeking inclusion of the aforesaid properties in the wakf proforma; since the said representation has not been acted upon, the instant writ petition has been filed seeking the aforesaid relief.
¶3Mr. R. Abdul Mubeen, learned counsel for the respondent wakf, accepting notice on behalf of the respondent, submitted that the petitioner's representation having been given way back in the year 2021, the same may not Page3 of 6 be available with the respondent and if the petitioner submits a fresh representation, the same will be considered by the respondent within a period of twelve weeks from the date of receipt of a copy of such representation.
¶4Heard the learned counsel on either side and perused the materials available on record.
¶5It is not in dispute that the petitioner has addressed a representation dated 06.09.2021 to the respondent seeking inclusion of certain properties in the wakf proforma. But, the stand of the learned counsel for the respondent is that the copy of the said representation may not be available with the respondent.
¶6In such view of the matter, in the considered opinion of this Court, the petitioner need not be directed to submit a fresh representation as submitted by the learned counsel for the respondent. Instead, considering the limited scope of the relief sought in the writ petition, without going into the merits of the case, this Court directs the petitioner to submit a copy of his representation dated
06.09.2021 to the respondent forthwith and the respondent shall consider and pass appropriate orders on the same, on its own merits and in accordance with law, after giving due notice to the petitioner and aggrieved persons, if any, within twelve weeks from the date of receipt of a copy of the said representation also in the event of the Wakf Board is formed with proper forum.
