ORDER The prayer in the Criminal Original Petition is to call for the records relating to the final report in C.C.No.2459 of 2025 on the file of the learned XXIII - Metropolitan Magistrate, Saidapet, Chennai.
¶2Upon perusing the first information report, the materials collected during the course of investigation and the final report, the allegation is that the first accused in this case was running a chit transaction and totally 54 victims being invested in the same and the money was not repaid to them. In all, totalling to Rs.1,04,42,615/-. Page3 of 6
¶3The contention of the learned counsel for the petitioners is that the first petitioner has already filed insolvency proceedings and the same is in the stage of the Administrator taking charge of the assets. As far as the petitioners 2 to 4 are concerned, except for being the family members, they are not involved in the crime. As far as the insolvency proceedings is concerned, it can be seen that the criminal prosecution cannot be stayed on account of the same. As far as the second contention relating to the other petitioners are concerned, upon perusal of the statements given by the victims, they have specifically made allegations about the role played by the petitioners 2, 3 and 4 and as such, the assertions of the learned counsel for the petitioners are factual in nature to be taken only during the course of the trial.
¶4Therefore, keeping open the liberty of the petitioners to raise all the defences during the course of the trial, the prayer to quash cannot be entertained. At this stage, the learned counsel for the petitioner pleads that the case can be expeditiously disposed of. In view of the fact that the case is of the year 2025 and there are 33 witnesses to be examined, let the learned XXIII-Metropolitan Magistrate, Saidapet, Chennai dispose of C.C.No.2459 of 2025 as expeditiously as possible. Accordingly, this Criminal Original Petition stands disposed of. Consequently, connected miscellaneous petition is closed. Page4 of 6
¶5Considering the nature of hardship that is pleaded with reference to Accused No.2, 3 & 4, their presence before the Trial Court except for the necessary hearings as may be insisted upon by the Trial Court shall stand dispensed with. 24-07-2026 KKN Page5 of 6 To
