Judgment

ORDER This Criminal Original Petition has been filed seeking transfer of the investigation in Crime No.347 of 2025 pending on the file of the second respondent to the file of the third respondent.

¶2The learned counsel for the petitioner submitted that the petitioner has lost 40 sovereigns of gold jewels and a sum of Rs.1,000/-. However, till date, no effective steps have been taken either to recover the stolen jewels or to resolve the case.

¶3Per contra, the learned Government Advocate (Criminal Side) appearing for the respondents submitted that the claim regarding 40 sovereigns was only a subsequent version. However, he fairly submitted that the case remains undetected and that the fingerprints lifted during the course of investigation have not matched with any available records so far. It is further submitted that all possible efforts are being taken to identify and apprehend the accused.

¶4Considering the submissions made on either side, this Court is of the view that the respondent police shall leave no stone unturned to detect the offence and complete the investigation at the earliest. The investigation shall be Page3 of 5 completed as expeditiously as possible, in any event, not later than five months from the date of receipt of a web copy of this order. The jurisdictional Deputy Superintendent of Police is directed to closely monitor the progress of the investigation.

¶5Needless to state that, upon detection of the case and recovery of the stolen articles, the quantum of the stolen property shall be assessed without reference to the initial statement recorded, wherein it was stated that only 19 sovereigns were stolen, since the consistent case of the defacto complainant is that the stolen jewels weighed 40 sovereigns.
