Judgment
Order This writ petition has been filed seeking the issuance of a writ of mandamus directing the respondents to reinstate the petitioner into service based on his representation dated 16.3.2026 within a time frame as may be fixed by this Court.
¶2It is the case of the petitioner that he was appointed as an Orthotic Technician in the District Differently Abled Welfare Office, Nagapattinam District, on 23.02.2016. He thereafter served in various districts and was transferred to Perambalur, where he joined duty on 25.05.2023. While serving in Perambalur, a complaint was lodged by one Ravi against the petitioner before the Vigilance and Anti-Corruption Department alleging that the petitioner demanded Rs.2,000/- as illegal gratification for processing a Government welfare scheme. Pursuant to the complaint, a trap was conducted on 12.03.2024, the petitioner was arrested, and a criminal case was registered against him. Based on the same, he was placed under temporary suspension on 12.03.2024 under Rule 17(e) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules. Page3 of 5
¶3It is the further case of the petitioner that he has been under suspension continuously for more than two years, without any review or reinstatement. Though his subsistence allowance was enhanced from 50% to 75% by proceedings dated 11.10.2025, he continues to remain under suspension. He would submit that the prolonged suspension has caused severe financial hardship to him and his family and that he has not violated any condition imposed during the period of suspension. The petitioner therefore submitted a representation dated 16.03.2026 requesting the 1st respondent to revoke his suspension and reinstate him in service. As no effective action was taken, the present writ petition has been filed seeking the aforesaid relief.
¶4Heard the learned counsel for the petitioner and the learned Government Advocate appearing for respondents.
¶5Considering the limited scope of the prayer sought in this writ petition, and without expressing any opinion on the merits of the case, this Court directs the 2nd respondent to consider the petitioner's representation dated 16.03.2026 and pass appropriate orders on merits and in accordance Page4 of 5 with law, within a period of six weeks from the date of receipt of a copy of this order.
¶6With the above direction, this Writ Petition is disposed of. No costs. 27-07-2026 Index: Yes/No Speaking/Non-speaking order SRN To
