Judgment

ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 3rd respondent to consider and dispose of the petitioner's father representation dated 06.01.2016.

¶2The learned counsel for the petitioner submitted that the petitioner's paternal grandfather was the absolute owner and in possession of the subject property by virtue of a registered Sale Deed dated 02.05.1950, and the revenue records stood in his name. After his demise, the petitioner's father succeeded to the property and continued in possession and enjoyment thereof. While so, the 5th and 6th respondents, having no right or interest over the property, got their names included in Patta No.519. Aggrieved thereby, the petitioner's father submitted a representation/appeal dated 06.01.2016 before the 3rd respondent seeking appropriate correction of the revenue records. In the meanwhile, the petitioner's father passed away on 18.12.2025. Page3 of 7

¶3The learned counsel further submitted that despite the lapse of several years, the said representation/appeal has not been considered and no final orders have been passed thereon. Hence, the petitioner has filed the present Writ Petition seeking a direction to the 3rd respondent to consider the petitioner's father's representation/appeal dated 06.01.2016.

¶4Mr. Vineeth P.R., learned Government Advocate appearing for the respondents 1 to 4, submitted that the representation submitted by the petitioner's father was made in the year 2016. He further submitted that, in the event of the petitioner submitting a fresh representation, the same may be considered by the third respondent, after issuing notice to the petitioner as well as the private respondents, in accordance with law.

¶5Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the petitioner, being one of the legal heirs, to submit a fresh representation to the third respondent seeking mutation of the revenue records, along with the representation already submitted by his father on 06.01.2016. On receipt of such representation, the third respondent, namely, the Sub-Collector, Gobichettipalayam, shall consider Page4 of 7 the same and pass appropriate orders on merits and in accordance with law, after issuing notice to the petitioner as well as the private respondents and affording them an opportunity for a personal hearing, within a period of six (6) weeks from the date of receipt of the said representation.

¶6With the above directions, this Writ Petition stands disposed of. There shall be no order as to costs. 07-08-2026 Asi To
