ORDER The petitioner apprehends arrest for the alleged offence under Sections 435 @ 435 IPC r/w Section 3(1) of TNPPDL Act in Crime No.268 of 2024 on the file of the respondent police seeks anticipatory bail. Page2 of 6
¶2The case of the prosecution is that during a get together party, there was a wordy quarrel between the petitioner and the de-facto complainant due to which the petitioner poured petrol and set fire to the car of the de-facto complainant. Hence, the case.
¶3The learned counsel for the petitioner submitted that the petitioner had earlier filed Crl.O.P. No. 15763 of 2024 seeking anticipatory bail, which was granted on 09.07.2024 on the condition that the petitioner deposit a sum of Rs.20,000/- to the credit of Crime No. 268 of 2024 within two weeks from the date of receipt of a copy of the order. He further submitted that since the petitioner is a daily wage earner, he was unable to raise the funds, resulting in the subsequent cancellation of his anticipatory bail. However, the petitioner has now mobilized the funds and is willing to deposit a sum of Rs.20,000/- as imposed by this Court. Hence, he prayed for the grant of anticipatory bail to the petitioner.
¶4The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution's case and did not seriously dispute the factum of the earlier grant of anticipatory bail to the petitioner.
¶5I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record. Page3 of 6
