ORDER The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 364 A, 342, 294(b), 323 and 506(ii) of PIC, in Crime No.118 of 2022, on the file of the respondent Police, seeks anticipatory bail. Page2 of 6
¶2The case of the prosecution is that the petitioner along with other paid one crore to the defacto complainant for purchase of Iridium, thereafter, the defacto complainant failed to produce any Iridium and repaid the entire amount which was received from them. Thereafter, the petitioner and others kidnapped the defacto complainant and received a sum of Rs.35 lakhs. So far the defacto complainant paid a sum of Rs.65 lakhs. Hence, the complaint.
¶3The learned counsel appearing for the petitioner submitted that the petitioner was previously granted bail by this Court on 29.06.2022 in Crl.O.P. No. 14978 of 2022. However, the petitioner was never informed about the bail order and was therefore unable to furnish sureties within a period of 15 days, causing the order to lapse. He only recently came to know about the order, and the petitioner now apprehends arrest by the respondent police. In the meantime, the respondent police have filed a charge sheet, which has been taken on file as C.C. No. 4969 of 2026 before the Judicial Magistrate No. I, Coimbatore. Hence, he prayed for the grant of anticipatory bail to the petitioner
¶4The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and, upon instructions, submitted that the petitioner has three previous cases which is subsequent to this occurrence. Hence, she opposed to grant anticipatory bail to the petitioner. Page3 of 6
¶5I have given my anxious consideration to either side submissions.
¶6In view of the above circumstances, the custodial interrogation of the petitioner is not required. Apart from that, the petitioner was previously granted bail by this Court in Crl.O.P. No. 14978 of 2022. Though the learned Government Advocate (Crl.Side) objected to the application on the ground that the petitioner has three previous cases pending against him, those cases were registered subsequent to the present occurrence. Hence, considering the totality of the circumstances, this Court is inclined to grant anticipatory bail to the petitioner, subject to certain conditions. At this juncture, the learned counsel for the petitioner voluntarily undertakes to pay a sum of Rs.50,000/- as non-refundable deposit to any of the welfare scheme without prejudice to his defence.
¶7Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date on which the order copy is made ready, before the learned Judicial Magistrate Court No.I, Coimbatore, on condition that the petitioner shall execute a bond for a sum of Rs.20,000/- (Rupees Twenty Thousand only), with two sureties each, for a like sum to the satisfaction of the learned Magistrate concerned, and on further conditions: Page4 of 6
(a) If the petitioner fails to surrender before the concerned learned Magistrate within a period of fifteen (15) days from the date of receipt of a copy of this order, this order shall stand automatically cancelled;
(b) The sureties shall affix their photographs and left thumb impression in the application for surety ship (Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019]'. The learned Magistrate shall obtain a copy of any one of identify proofs to ensure their identity;
(c) The petitioner is directed to make a non-refundable deposit of Rs.50,000/- [Rupees Fifty Thousand Only] towards the account of M/s.Patient Welfare Society, Anayankadu Road, Vasantha Mill, Singanallur, maintained at Canara Bank, Singanallur Branch, No.2225, Trichy Road, Singanallur, Coimbatore District-641015, bearing SB Account No.110210036953, IFSC Code No.CNRB0016562, MICR No.641015100 and to produce the Bank challan before the concerned Magistrate and the receipt shall be produced at the time of executing the bond.
(d) The petitioner shall report before the respondent police daily at 10.30 am for a period of two weeks and thereafter as and when required for interrogation;
(e) On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate actions against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on anticipatory Page5 of 6 bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji v. State of Kerala [(2005) AIR SCW 5560];
(f) If the petitioner thereafter absconds, a fresh FIR can be registered under Section 269 of BNS Act. 29-07-2026 DRL To
