Judgment

ORDER The petitioner, who was arrested and remanded to judicial custody on

11.07.2026 for the alleged offences punishable under Sections 303(2) of BNS @ 317(2) of BNS, Section 25(1B)(a) of the Arms Act, Section 3 of TNPPDL Page2 of 4 Act and Section 136(1)(a) of the I.E.Act, in Crime No.58 of 2026 on the file of the respondent police, seeks bail.

¶2The case of the prosecution is that the petitioner, along with other persons, committed theft of 60 kilograms of copper coil and 102 kilograms of transformer oil, valued at approximately Rs. 75,000/-, from the SS 6 Transformer installed by the Tamil Nadu Electricity Board, and was also found in possession of a country-made gun without any valid licence. Hence, the complaint.

¶3The learned counsel for the petitioner submitted that the petitioner was arrested and remanded to judicial custody since 11.07.2026, he has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant bail to the petitioner.

¶4Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner is arrayed as A4 in a case involving the theft of copper coil and transformer oil from a transformer installed by the Tamil Nadu Electricity Page3 of 4 Board. He further submitted that the petitioner has five previous cases of a similar nature pending against him and, therefore, opposed the grant of bail to the petitione

¶5I have given my anxious consideration to either side submissions and perused the materials available on record.

¶6Considering the facts and circumstances of the case, and taking note of the submissions made by the learned Government Advocate (Crl. Side), it is seen that the petitioner has five previous cases of a similar nature pending against him. In view of his adverse antecedents, this Court is of the firm view that it is not a fit case to grant regular bail to the petitioner at this stage.

¶7Accordingly, this Criminal Original Petition stands dismissed. 24-07-2026 DRL To
