¶2The case of the prosecution is that on the date of occurrence on
12.09.2004, one Saravanan met with an accident and sustained severe injury. The said accident was done by a college bus bearing Reg No.TN-02-C-4777. The person who sustained severe injury had filed claim petition MCOP No. 5414 of 2004 before the Motor Accidents Claims Tribunal (MACT), III Judge, Small Causes Court, Chennai. The National Insurance Company who is the respondent in said claim proceedings filed appeal before this Court on the ground that the Insurance Policy for the said bus bearing registration No.TN-02-C-4777 is expired and the policy submitted by the claimant is fabricated one. This Court vide order dated 21.04.2021 in CMA No. 2985 of 2011 confirmed the order. Aggrieved, the Insurance company filed Special Leave Petition before the Hon'ble Supreme Court. The Hon'ble Supreme court directed the DGP, Tamil Nadu, to take effective action against the persons who are involved to fabricate the Insurance Policy in S.L.P(Civil). No. 1003 of 2022 dated
02.04.2026.
¶3The learned counsel for the petitioner submitted that the petitioner has been incarcerated since 11.06.2026. He further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prays for grant of bail to the Petitioner.
¶4Per contra, the learned Government Advocate (Criminal Side) appearing for the Respondent Police reiterated the prosecution case and Page3 of 4 submitted that the FIR came to be registered based upon the direction of the Hon'ble Supreme Court in respect of a fake insurance policy for the purposes getting the Motor Accident claims. He further submitted that the investigation is still pending. Hence, he opposed the grant of bail to the Petitioner.
¶5I have given my anxious consideration to either side submissions and perused the materials available on record.
¶6Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); considering the totality of the circumstances, and upon the fact that the investigation is still pending, this Court is of the firm view that it is too premature to consider the bail application at this stage. Hence, this Court is not inclined to grant bail to the petitioner at this stage.
¶7Accordingly, this Criminal Original Petition stands dismissed. 29-07-2026 SHL To:
