Judgment

ORDER By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself.

¶2The present writ petition has been filed praying for a writ of Mandamus directing the 1st respondent to consider and pass orders on the petitioner's representation dated 15.07.2026 within a time frame as fixed by this Court, permitting the petitioner to extract and transport the permitted 104 cubic meters of alluvial soil from Thuraimangalam small tank in Survey no.313/3 to his agricultural land in Survey no.313F using a lorry/truck and excavator.

¶3Learned counsel for petitioner would submit that petitioner is the owner of agricultural land measuring an extent of 1.22 cents comprised in Survey No.313F, situated at Thuraimangalam area and would submit that the land requires enrichment and levelling with alluvial soil to optimize agricultural productivity. He would further submit that based on District Gazette Notification, petitioner submitted an online application and was granted permission by the 2nd respondent on 21.06.2026 to extract alluvial soil from Thuraimangalam Small Tank. Learned counsel for petitioner would submit that petitioner's land is situated about 7 kms (approx.) away from Thuraimangalam Small Tank. Therefore, petitioner submitted a representation before respondents Page3 of 5 on 15.07.2026 seeking permission to utilise a lorry/truck for excavation instead of a tractor, however, the same is stated to be kept pending. Agreed to by the learned counsel for petitioner.

¶5In view of the same, the writ petition stands disposed of. It is open to the petitioner to submit any relevant government orders before the respondents. If any orders or government order are placed before the respondnets, the same shall be considered by respondents while passing the above order on petitioner's representation dated 15.07.2026 and pass appropriate orders in accordance with law, after issuing notice and after affording reasonable opportunity of hearing to petitioner and any other interested persons within a period of three (3) weeks from the date of uploading of web copy without waiting for receipt of certified copy of the order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the representation on its own merits and in accordance with law.
