ORDER The prayer in this Criminal original is to quash the First Information Report in Cr.No.191 of 2024 dated 17.10.2024 on the file of the first respondent. It can be seen that the same is registered for the offences under Sections 406, 420 and 120B of Indian Penal Code.
¶2The learned counsel for the petitioner would submit that the petitioner was never arrayed as an accused in the FIR. Initially, the petitioner was even only summoned as a witness. Subsequently they are now portraying him as an accused. The case is also kept pending and the petitioner is made to face the case without even any material aspect as against the petitioner
¶3Per contra, the learned Government Advocate (Crl. Side) would submit that it is true that the petitioner's name was originally not mentioned in the FIR. Subsequently, it was noted that a sum of Rs.1,25,00,000/- has gone to the Page3 of 5 petitioner's account. The petitioner was summoned and information was sought for and suspecting the petitioner's role, summon is also issued. The investigation is now in the advanced stage.
¶4I have considered the rival submissions made and perused the material records of the case.
¶5During the course of investigation, the Investigating Officer stumbles upon information to add any person apart from the one who is mentioned in the FIR, the same by itself cannot be found fault with. On the other hand, it is the duty of the Investigating Officer to investigate the offence in a fair and transparent manner and to file a final report as against any or all of the persons against whom the offences are made out.
¶6In view thereof, when investigation is said to be in an advanced stage, entertaining the quash petition on behalf of the petitioner to thwart the very investigation itself does not arise. Let the investigation be completed and if only any final report is filed without any material against the petitioner, the petitioner will be entitled to agitate the same in the manner known to law. With such liberty kept open to the petitioner, this Criminal Original Petition stands disposed of. Consequently, connected Miscellaneous Petition is closed. Page4 of 5
¶7The respondent police is directed to complete the investigation within a period of two months from the date of receipt of web copy of this order. 29-07-2026 DP To
