ORDER This writ petition is filed for the following relief : "calling for the record relating to the impugned proceedings issued by the fourth respondent in R.C. No.8318/B4/2016 dated 18.04.2017 and to quash the same and consequently directing the respondents to count the service of petitioner in the sixth respondent school with effect from
06.06.1997 and all consequential benefits accordingly, along with interest within a time frame to be fixed by this Court."
¶2The petitioner was appointed as a Secondary Grade Teacher in D.M. High School, Kalrayan Hills, Kallakurichi and joined duty on 06.06.1997. He Page3 of 6 was promoted to the post of B.T.Assistant (Science) from 04.03.2015, granted Selection Grade from 04.03.2025 and subsequently, superannuated on
31.07.2026.The petitioner, in compliance with G.O.Ms.No.155, dated
03.10.2002, had undergone child psychology training for a month. However, after completion of the training, his appointment was approved with effect from
01.06.2003 instead of 06.06.1997. Similarly placed persons have obtained orders approving their appointment from the date of joining and therefore, the petitioner is also entitled to the same. Hence the writ petition.
¶3The learned counsel for the petitioner had relied upon the order passed by this very Bench in a case involving similar facts in C.Vilvanathan Vs. The State of Tamil Nadu, Rep. By its Principal Secretary, Education Department and 4 others (W.P.No.15095 of 2026 decided on 24.04.2026), allowing the writ petition. The relevant portion of the said order is extracted hereunder: "6. It is seen that a similarly placed person, J.Wesley Prabhu, had already filed a writ petition in W.P.No.2694 of 2020 and this Court observed that the petitioner therein was entitled for the relief claimed. Challenging the said order, the State has preferred the writ appeal in W.A.No.795 of 2021 and the same was dismissed. Pursuant to the order of the writ court, the second respondent issued orders in favour of the said J.Wesley Prabhu. Therefore, the stand taken by the Additional Government Pleader cannot be countenanced. Considering the above, the petitioner, Page4 of 6 who is similarly placed is therefore entitled to the very same relief.
¶7Accordingly, this writ petition is allowed subject to the result of the SLP and the impugned order passed by the fourth respondent dated 05.08.2024 is hereby quashed and the respondents are directed to count the service of the petitioner from 03.07.1996 and calculate the pensionary benefits and all consequential benefits accordingly with appropriate interest. Consequently, connected miscellaneous petition is closed. "
¶4The aforesaid decision in C.Vilvanathan, supra, applies on all fours to the case in hand and therefore, this writ petition is allowed on the same lines. No costs. Consequently, connected miscellaneous petitions stand closed. 06-08-2026 Index: Yes/No Speaking/Non-speaking order rap To Page5 of 6
