3.The Administrator, Tamil Nadu State Transport Corporation EPF Trust, Pallavan House, Thiruvalluvar Salai, ..Respondents in W.P.No.30845 of 2026 Common Prayer : Writ Petitions filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, directing the respondents to pay interest for the belated payment of Provident Fund, Death cum Retirement Gratuity, Encashment of Earned Leave, Surrender leave, and Commuted Value of Pension to the other petitioners at the rate of 12% per annum within the time frame fixed by this Court. Page3 of 6 In both WPs : For Petitioners: Mr.N.K.Ponraj For Respondents: Mr.M.Murali Vinodh, Standing Counsel for R1 & R2 ***** COMMON ORDER These writ petitions are filed for the following reliefs: "directing the respondents to pay interest for the belated payment of Provident Fund, Death cum Retirement Gratuity, Encashment of Earned Leave, Surrender leave and Commuted Value of Pension to the other petitioners at the rate of 12% per annum within the time frame fixed by this Court."

¶2The brief facts which has culminated in the filing of these writ petitions are set out below:

2.1. It is the case of the petitioners that they joined the service of the respondent Corporation and retired from service on attaining the age of superannuation. The respondents settled the Provident Fund, Death cum Retirement Gratuity, Encashment of Earned Leave, Surrender leave, and Commuted Value of Pension with a delay. Therefore, the respondents are Page4 of 6 legally bound to pay interest to the petitioners. Therefore, the petitioners made several representations to the respondents to pay the interest at the rate of 6% p.a., for the belated payment of the petitioners' Provident Fund, Death cum Retirement Gratuity, Encashment of Earned Leave, Surrender leave and Commuted Value of Pension. Since there is no response, the petitioners are before this Court.

¶3Heard the learned Counsel on either side and perused the materials available on record.

¶4Admittedly, the Provident Fund, Death cum Retirement Gratuity, Encashment of Earned Leave, Surrender leave, and Commuted Value of Pension have been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same.

¶5Accordingly, the writ petitions are disposed of and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Provident Fund, Death cum Retirement Gratuity, Encashment of Earned Leave, Surrender leave, and Commuted Value of Pension to the petitioners Page5 of 6 within a period of one (1) month from the date of receipt of a copy of this order. No costs. Consequently, the connected miscellaneous petitions are ordered subject to payment of separate Court fee. 06-08-2026 Index: Yes/No Speaking/Non-speaking order rap To
