Judgment

ORDER The present Writ Petition has been filed challenging the impugned order of rejection dated 18.05.2026 passed by the third respondent.

¶2The learned counsel for the petitioner submitted that the petitioner had purchased a plot measuring an extent of 1,200 sq.ft. situated at Abirami Nagar Annex, 4th Street, bearing Plot No.215, comprised in Survey No.127/49, Maduravoyal Village, Chennai, and had obtained a building plan from the Maduravoyal Municipality. Since there were certain deviations in the construction, the Greater Chennai Corporation issued a lock and seal notice. In view of the same, the petitioner submitted an application before the third Page2 of 6 respondent seeking issuance of patta. However, the said application came to be rejected. Challenging the same, the present Writ Petition has been filed.

¶3Mr.B.Karthikeyan, learned Additional Government Pleader appearing for the respondents, submitted that the rejection order was passed by the third respondent on the ground that the survey number was wrongly mentioned and that the extent of the property differs from that mentioned in the sale deed. He further submitted that the petitioner has also preferred a statutory appeal before the second respondent/Revenue Divisional Officer against the said order and, therefore, the petitioner has to pursue the said statutory remedy before the second respondent.

¶4In response, the learned counsel for the petitioner would submit that, in view of the pendency of the statutory appeal, he would restrict his prayer to a direction to the second respondent to dispose of the appeal within a time frame to be fixed by this Court.

¶5Admittedly, against the order of rejection passed by the third respondent rejecting the petitioner's application for issuance of patta, the petitioner has preferred a statutory appeal before the second respondent. In such Page3 of 6 circumstances, this Court is not inclined to entertain the present Writ Petition, since the statutory appeal is pending before the competent authority.

¶6Hence, considering the fact that the learned counsel for the petitioner has restricted his prayer to a direction for disposal of the statutory appeal, this Court directs the second respondent/Revenue Divisional Officer to consider and dispose of the petitioner's statutory appeal dated 17.06.2026 and pass appropriate orders on merits and in accordance with law, after issuing notice to the petitioner and affording her an opportunity of personal hearing, within a period of six (6) weeks from the date of receipt of a copy of this order.

¶7With the above directions, the present Writ Petition stands disposed of. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is also closed. 07-08-2026 Asi Page4 of 6 To
