Judgment

Order This Writ petition has been filed directing the Respondents to ensure petitioners possession of the property to the entire extent of 1.59 Acres after clearly demarcating the boundaries in accordance with the Patta.

¶2The learned counsel appearing for the petitioner submitted that the petitioner is the absolute owner of the property measuring an extent of 1.59 acres, situated at S.F. No. 134/1A1A1A of Koladi Village, Poonamallee Taluk, Thiruvallur District, and is in peaceful possession and enjoyment of the same. Subsequently, land acquisition proceedings were initiated against the petitioner's property, which were later quashed at the instance of the petitioner herein by way of a writ petition filed before this Court. Following this, the Tahsildar of Poonamallee Taluk issued a patta wherein the extent of the property was erroneously recorded as 0.62.50 hectares. Consequently, the petitioner submitted a representation dated 01.03.2026 to the Tahsildar of Poonamallee Taluk, requesting to survey, demarcate, and mark the boundaries of the land measuring an extent of 1.59 acres in S.F. No. 134/1A1A1A. Since the said representation has not been considered, the petitioner has approached this Court. Page3 of 5

¶3Mr.A.Maheshnath, learned Government Advocate, who accepts notice on behalf of the respondents would submit that the petitioner's land will be surveyed and demarcated based on his representation dated 01.03.2026 along with necessary police aid, within a time frame to be fixed by this Court.

¶4Heard the learned counsel for the petitioner as well as the learned Government's Counsel appearing for the respondents.

5.Considering the submissions made by both parties and in view of the limited prayer sought for in this writ petition, this Court without expressing any opinion on the merits of the case, directs the 4th respondent to consider the petitioner's representation dated 01.03.2026 and conduct a survey and demarcate the subject properties, within a period of four (4) weeks from the date of receipt of a copy of this order, after issuing prior notice and affording an opportunity of personal hearing to the petitioner and other parties concerned. If any need arises for Police assistance, it is open to the official respondents to request for Police protection from the jurisdictional Police. If any such request is made, the jurisdictional Police is directed to provide an adequate Police protection for conducting the survey.

6.In the event of any dispute regarding possession, the respondents shall not adjudicate upon the question of title. The petitioner and the concerned Page4 of 5 parties are at liberty to approach the competent Civil Court for recovery of possession and for appropriate reliefs in accordance with law. The official respondents shall not involve themselves in such proceedings or take any action affecting the rights of the parties unless specifically directed by the competent Civil Court.

7.With the above direction, this writ petition is disposed of. No costs. 06-08-2026 Index: Yes/No Speaking/Non-speaking order SK To
