ORDER This writ petition has been filed to direct the respondents to consider the petitioner's representation dated 10.07.2026. Page2 of 4

¶2Learned counsel for the petitioner would submit that the petitioner has made a representation dated 10.07.2026 before the respondents seeking sub division and issuance of patta on his favour in respect of the subject property. However, the said representation was not considered, as on date. Hence, this writ petition.

3.Mr.M.Sivavarthanan, learned Special Government Pleader accepts notice on behalf of respondents and submitted that the petitioner's representation dated 10.07.2026 will be considered within a period of four weeks.

¶4Heard the learned counsel on either side and perused the materials available on record.

¶5Considering the facts and circumstances of the case and the submissions made on either side, without expressing any opinion on the merits of the case, this Court directs the third respondent to consider the petitioner's representation dated 10.07.2026 and conduct a survey of the subject property by employing Differential Global Positioning System (DGPS) equipment, after issuing notice to the petitioner and other aggrieved parties, if any. The entire cost of conducting the DGPS survey shall be borne by the petitioner. The Page3 of 4 aforesaid exercise shall be completed within a period of four (4) weeks from the date of receipt of a copy of this order.

¶6It is made clear that the petitioner shall not cause any disturbance during or upon completion of the survey. In the event that any disturbance arises, the surveying authority is empowered to seek the assistance of the jurisdictional Police, and the jurisdictional Police are mandated to provide necessary police protection. In the event that the subject land under survey is in the possession of either the petitioner or any other concerned party, the recovery of possession can only be effected through the due process of law before the competent Civil Court, unless the parties arrive at an amicable settlement; under no circumstances shall the respondents engage in taking over possession after completing the survey to hand it over to any party. Such exercise shall be carried out exclusively through the competent Civil Court. With the above directions, the Writ Petition stands disposed of. There shall be no order as to costs. 13-08-2026 Index: Yes/No Speaking/Non-speaking order VM Page4 of 4
