Judgment
ORDER The prayer in this criminal original petition is to quash the First Information Report (FIR) in Crime No.007 of 2026, pending on the file of the first respondent police.
¶2The gist of the allegations in the case is that the first petitioner/Accused No.1 arranged a person to impersonate the original owner and executed a document, registered as Document No.15150 of 2019 in the name of his wife, the second petitioner herein. It is further alleged that a fake Aadhaar ID was fabricated to execute a General Power of Attorney in favour of one Chandramouli by impersonating the original owner of the property.
¶3The learned counsel for the petitioners submitted that the transactions in question occurred in the year 2019. Subsequently, rival title claims arose between the two groups and two civil suits are already pending trial before the Civil Court. It is contended that while the civil disputes have been pending for a long time, the present complaint has been lodged suddenly after a lapse of seven years.
¶4This Court has considered the submissions made by the learned counsel for the petitioners and perused the materials available on record.
¶5It may be true that civil proceedings are pending regarding the title to the property and the parties will ultimately be bound by the decree of the Civil Court. However, if a civil dispute also involves allegations that are criminal in nature, it cannot be said that no investigation should be carried out into the aspect of criminality. When it is alleged that a fake Aadhaar card has been forged and a document has been executed through impersonation, the matter certainly requires a thorough investigation by the respondent police.
¶6Therefore, while reserving the liberty of the petitioners to raise all available grounds at the appropriate stage, this Court finds that this is not a fit case to stifle the investigation at its inception.
¶7Accordingly, this criminal original petition stands disposed of. Connected miscellaneous petition is closed. 06-08-2026 Sni
