Judgment

ORDER The present Writ Petition has been filed seeking issuance of writ of mandamus directing the respondents to maintain the land measuring an extent of 50 cents in Punjai S. No 557/3 situated at Bogalur Village, Annur Taluk, Page2 of 4 Coimbatore District as Boodan Yagna Property granted by the Tamil Nadu Government.

¶2The learned counsel appearing for the petitioner submitted that the family of the petitioner, as a landless poor farmers, has been in possession of 50 cents of land in Punjai S. No 557/3 situated at Bogalur Village, Annur Taluk, Coimbatore District by cultivating the same from time immemorial. Their possession of the said land was regularised by the first respondent by granting assignment deed dated 12.08.1971 under the welfare scheme of Boodan Yagna to the poor people belonging to Scheduled Caste community. Now, all of a sudden, under the pretext of laying road, without issuing any notice or providing any compensation, the respondent authorities approached the petitioner to vacate the land otherwise police force will be used. Hence, this Writ Petition.

¶3The learned Special Government Pleader appearing for the respondents seeks time to find out as to whether the assignment is still in force or not, or any violation of conditions by the petitioner.

¶4Heard the learned counsel for the petitioner and the learned Special Government Pleader for the respondents and perused the materials available on record.

¶5Upon hearing the submission of the learned counsel on either side and Page3 of 4 on perusal of the documents, it is an undisputed fact that the petitioner's family has been in possession of the land in Punjai S. No 557/3 situated at Bogalur Village, Annur Taluk, Coimbatore District by doing cultivation and they have been granted assignment deed on 12.08.1971 under Boodhan Yagna scheme. Such being the case, in the event, if there had been any violation of conditions or if it is not the assigned land, the respondent authorities ought to have issued notice to the petitioner. But it is not proper for the respondent authorities to direct the petitioner to vacate the land without any notice at all. In this regard, the petitioner made a representation on 14.07.2026 to the respondents seeking not to disturb his possession. Therefore, the second respondent is directed to conduct an enquiry as to whether it is an assigned land or not, or any violation of conditions. In the event, if the said land is an assigned land, the respondents are directed not to disturb the possession of the petitioner. However, if the respondents intend to acquire the land, they can very well acquire the land after payment of compensation to the petitioner by following due process of law.

¶6With the above direction, this writ petition stands disposed of. No costs. 07-08-2026 Index: Yes/No Speaking/Non-speaking order SRM Page4 of 4
