Judgment
ORDER The petitioner seeks for police protection with respect to a common pathway said to be a Government Poramboke land. His attempts to use the pathway is said to be obstructed by respondents No.4 to 8. He states that tuber crops grown by him are ready for harvest, but the respondents are preventing him from removing the same from his lands.
¶2A perusal of the papers indicate that the petitioner, as a plaintiff, has already approached the District Munsif Court, Harur seeking for a declaration that the pathway is a public pathway and for injunction restraining the defendants stated therein from interfering with his possession and usage of the pathway. ¶3When the matter is pending before the jurisdictional civil Court, it may not be appropriate for this Court to issue a mandamus as sought for. It is open to the petitioner to move the District Munsif Court, Harur, seeking such interlocutory reliefs as it is open to him under the Code of Civil Procedure. I am sure, if such an application is filed indicating the urgency, the learned District Munsif, Harur, will give priority to the said application and dispose it off.
¶4With the above observations, this Writ Petition is dismissed. No costs. Consequently, connected Writ Miscellaneous Petition is closed. 13-08-2026 smv Index: Yes/No Speaking/Non-speaking order To
