Judgment

ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 3rd and 4th respondents to consider the petitioner's representation dated 16.03.2026.

¶2The learned counsel for the petitioner submitted that the petitioner is the absolute owner and is in peaceful possession and enjoyment of the lands comprised in R.S. No.178/1, measuring an extent of 1.01 acres, and R.S. Page2 of 6 Nos.178/3B and 178/4, measuring a combined extent of 3.05 acres, situated at Mullampatti Village, Perundurai Taluk, Erode District, which were allotted to him under a registered Partition Deed dated 15.12.1980, bearing Document No.1592 of 1980. Though the partition took place more than 45 years ago, the revenue records continue to stand in the names of the co-sharers under Joint Patta No.234. Hence, the petitioner submitted a detailed representation dated

16.03.2026 to the 3rd and 4th respondents, requesting survey, demarcation, sub-division and issuance of an individual patta in respect of his lands. However, the said representation has not been considered till date. Aggrieved by the inaction on the part of the 3rd and 4th respondents, the petitioner has been constrained to file the present Writ Petition.

¶3In response, Mr. P.Elayaraj Kumar, learned Special Government Pleader appearing for the respondents submitted that the petitioner's representation dated 16.03.2026 would be considered and appropriate orders would be passed thereon within a period of eight weeks.

¶4Considering the facts and circumstances of the case and the submissions made on either side, this Court, without going into the merits of the case, directs the 3rd and 4th respondents to consider the petitioner's representation dated 16.03.2026 seeking survey, demarcation, sub-division and issuance of an Page3 of 6 individual patta and pass appropriate orders thereon, on merits and in accordance with law, after issuing notice to the petitioner as well as the interested parties, if any, and affording them an opportunity of personal hearing, within a period of eight (8) weeks from the date of receipt of a copy of this order.

¶5With the above observations and directions, this Writ Petition is allowed. No costs. 07-08-2026 Asi To
