Judgment
Order These Criminal Original Petitions seek to quash the S.C.No.409 of 2025 on the learned Additional District and Sessions Judge, Mahalir Needhi Mandram, Allikulam, Chennai for alleged offences under Sections 376 (2)(n), 417, 294(b) & 506(ii) of IPC., on the ground of compromise between the parties. The parties are present before the Court and, on examination, stand by their compromise and do not want the case to proceed further.
¶2The broad contours of the High Court's power to exercise extraordinary jurisdiction under Section 482 of the Cr.P.C. and Section 528 of the BNSS in respect of compromise of non-compoundable offences are laid down by the Hon'ble Supreme Court of India in Gian Singh -Vs-State of Punjab and Another (2012 10 SCC 303) and other subsequent judgments.
¶3The gist of facts leading to the instant case are that the actual background in which the case is registered is that the de-facto complainant alleges false promise to marry, pursuant to which, she had physical relationship with the petitioner in Crl.O.P.No.22016 of 2026. It is now submitted before this Court that the parties have moved on and the de-facto complainant is pursuing higher studies and that in her own interest, she does not want to pursue the Page4 of 6 complaint. Considering the allegations made and the submissions of the de-facto complainant before this Court, the entire issue can be treated as private in nature.
¶4Thus, it can be seen that these matters are fit for the exercise of extraordinary jurisdiction to quash the cases on compromise.
¶5Accordingly, the Crl.O.P. No.22016 of 2026 & Crl.O.P.No.35135 of 2025 stand allowed. The proceedings in S.C.No.409 of 2025 on the learned Additional District and Sessions Judge, Mahalir Needhi Mandram, Allikulam, Chennai shall stands quashed. 07-08-2026 DP Page5 of 6 To
