ORDER

¶1This Criminal Original Petition seeks to quash the F.I.R. in Crime No.18 of 2023, on the file of the Inspector of Police, District Crime Branch, Cuddalore for alleged offences under Sections 406 and 420 of I.P.C. on the ground of compromise between the parties. The parties are present before the court and, on examination, stand by their compromise and do not want the case to proceed further.

¶2The broad contours of the High Court's power to exercise extraordinary jurisdiction under Section 482 of the Cr.P.C. and Section 528 of the BNSS in respect of compromise of non-compoundable offences are laid down by the Page3 of 5 Hon'ble Supreme Court of India in Gian Singh -Vs-State of Punjab and Another (2012 10 SCC 303) and other subsequent judgments.

¶3The gist of facts leading to the instant case are that the de facto complainant alleges that sum of Rs.25,00,000 was due to him and the accused cheated him. It is submitted that the said amount is paid to the de facto complainant through RTGS and he has also received the same. The de facto complainant submits that the case need not be proceeded further.

¶4Thus, it can be seen that this matter is a fit case for the exercise of extraordinary jurisdiction to quash the case on compromise.

¶5Accordingly, this Crl.O.P. No.21239 of 2026 stands allowed. The F.I.R. in Crime No. 18 of 2023 on the file of the Inspector of Police, District Crime Branch, Cuddalore stands quashed.

¶6It is submitted at this stage that the petitioners 1 and 3 are in Central Prison, Cuddalore and the 2nd petitioner is in Sub-Jail for Women, Cuddalore, they can be released forthwith if they are not required for any other case. 31-07-2026 RPP N.B. : Issue order copy today Page4 of 5 To
