Judgment
ORDER The prayer in this Criminal Original Petition is to modify the condition imposed by the order dated 28.07.2026 made in CRL.MP.No.2548 of 2026 on the file of the learned Principal District and Sessions Judge, Coimbatore. Page2 of 5
¶2Upon perusal of the materials available on record and after hearing the learned counsel on either side, it is seen that the petitioner had approached the learned Principal District and Sessions Judge, Coimbatore, seeking anticipatory bail in connection with a case relating to the seizure of tobacco products weighing about 15 kilograms. While granting anticipatory bail, the learned Principal District and Sessions Judge imposed, among other conditions, a direction to deposit a sum of Rs.1,00,000/- to the credit of Crime No.157 of 2026.
¶3Having regard to the quantity of tobacco products allegedly seized from the petitioner, no exception can be taken to the imposition of such a condition. However, the learned counsel for the petitioner submitted that the petitioner is a daily wage labourer and is unable to mobilise a sum of Rs.1.00.000/-. It is further submitted that the petitioner has instructed the learned counsel to state that he would be in a position to comply with the condition if the amount is reduced to Rs.50,000/-.
¶4Considering the submission made on behalf of the petitioner and taking note of his financial condition, this Court is of the view that the condition directing deposit of Rs.1,00,000/- can be modified by reducing the amount to Rs.50,000/-. Page3 of 5
¶5Accordingly, this Criminal Original Petition is allowed on the following terms:
(i) The order dated 28.07.2026 made in CRL.M.P.No.2548 of 2026 on the file of the learned Principal District and Sessions Judge, Coimbatore, is modified insofar as paragraph 4(iv) is concerned. The petitioner shall deposit a sum of Rs.50,000/- instead of Rs.1,00,000/- to the credit of Crime No.157 of 2026.
(ii) All the other conditions imposed by the learned Principal District and Sessions Judge, Coimbatore, shall remain unaltered.
(ii) In view of the modification now made, the petitioner is granted a further period of two weeks from the date of receipt of the web copy of this order to comply with the modified condition. 06-08-2026 av Page4 of 5 To
