ORDER The petitioner, who was arrested and remanded to judicial custody on
13.02.2025 for the alleged offences under Sections 147, 148, 302 and 109 of IPC in S.C.No.80 of 2024 on the file of the II Additional District and Sessions Page2 of 6 Judge, Arakkonam, Ranipet District in Crime No.427 of 2019 on the file of the respondent police, seeks bail.
¶2The learned counsel for the petitioner submitted that NBW was issued on 14.08.2025 and was produced to report under PT Warrant on 26.04.2026. Since then, the petitioner has been incarcerated. He further submitted that he was arrested in S.C.No.216 of 2024 on 19.03.2025, therefore on the date of NBW, he was already on jail and he was enlarged on bail in SC.No.216 of 2014 in Crime No.95 of 2016 only on 13.05.2026.
¶3The learned Government Advocate (Crl.Side) objected the bail application on the ground that the petitioner has got two murder cases, one POCSO case and other IPC offences totalling 10 previous cases pending against him. Hence, he opposed the grant of bail to the Petitioner.
¶4I have given my anxious consideration to either side submissions and perused the materials available on record.
¶5Considering the facts and circumstances of the case; taking note of the submission made by the learned Government Advocate (Crl.Side); considering the fact that on the date of the NBW, the petitioner was already arrested in some other case. It is also relevant to mention that there are about 34 witnesses. Page3 of 6 Even now, no witness has been examined and summons were issued only to LW1. In such view of the circumstances, taking into consideration of his incarceration in the instant case since 26.04.2026 and upon the fact that in the connected case, the petitioner was already enlarged on bail in Crl.OP.No.11546 of 2026 dated 13.05.2026, and the stage of the trial namely P.W-1 Chief continuation, this Court is inclined to enlarge the petitioner on bail, subject to certain conditions.
¶7Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties each, for a like sum to the satisfaction of the learned II Additional District and Sessions Judge, Arakkonam, Ranipet, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity; [b] the petitioner shall report before the Court concerned daily at 10.30 a.m., until further orders; [c] for relaxation, the petitioner is at liberty to move any relaxation petition in respect of his conditions before the Sessions Court. [d] the petitioner shall not abscond either during Page4 of 6 investigation or trial; [e] the petitioner shall not tamper with the evidence or witness either during investigation or trial; [f] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283]; [g] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 07-08-2026 SHL Note:
