ORDER This writ petition has been filed seeking to issue a direction to the respondent to restore the petitioner to the post of Academic Level-12 with effect from 07.10.2023 and to pay all the monetary benefits from 07.10.2023. Page2 of 6

¶2The case of the petitioner is that he joined the respondent University in the year 2005 in the post of Lecturer, which was subsequently re-designated as Assistant Professor. As on 08.10.2018, the petitioner was drawing pay in Academic Level 12 with a Grade Pay of Rs.8,000/-. While so, a charge memo dated 02.06.2017 was issued to him. Pursuant thereto, by order dated

08.10.2018, a punishment of reduction in pay from Academic Level 12 with Grade Pay of Rs.8,000/- to Academic Level 11 with Grade Pay of Rs.7,000/- was imposed. Subsequently, by order dated 11.10.2018, the period of suspension was treated as leave available to the credit of petitioner and period of suspension was treated as leave on loss of pay. Further by an order dated

22.10.2018, the respondent cancelled the annual increment granted with effect from 01.04.2018.

¶3Challenging the above orders, the petitioner filed a writ petition before this Court in W.P.No.31432 of 2018. During the pendency of the said writ petition, the punishment came to an end on 07.10.2023 and consequently, the petitioner became entitled to restoration of pay in Academic Level 12 with Grade Pay of Rs.8,000/-. However, the said writ petition was dismissed vide order dated 19.02.2025. Aggrieved by the same, the petitioner has preferred a writ appeal in W.A.No.1974 of 2025, which is presently pending consideration. In the meanwhile, the petitioner made a representation to the respondent seeking Page3 of 6 restoration to Academic Level 2 with effect from 07.10.2023 along with all consequential monetary benefits. However, the said representation has not been considered. Hence, the present writ petition.

¶4Heard the learned counsel for the petitioner and the respondent and perused the materials available on record.

¶6The punishment is for a period of five years i.e., from 08.10.2018 to

07.10.2023. The said period has come to an end on 07.10.2023 and the petitioner is yet to be restored to the post of Academic Level-12 in the Grade pay of Rs.8,000/- and his monetary benefits has also not been issued. Therefore, this writ petition is disposed of with a direction to the respondent to restore the petitioner to Academic Level 12 with effect from 07.10.2023 and to disburse all consequential monetary benefits from the said date.
