G.Selvakodi v. The Regional Manager

ORDER (Order of the Court was made by the Hon'ble Chief Justice) This petition under Article 226 of the Constitution of India seeks writ of mandamus directing the respondents to register the sale certificate in favour of the petitioner and consequently, direct the respondents to deliver the physical possession of the auction property and also hand over the original title deeds of the auction property to the petitioner.

¶2Learned counsel for the bank submits that the original title deeds have already been handed over to the petitioner on 20.08.2025 under acknowledgement. Since the petitioner has not approached the bank for registration of sale certificate and the delivery of physical possession, the bank is not in a position to do the same.

¶3The learned counsel for the petitioner submits that the petitioner is ready to approach the bank, which, in turn, shall take necessary action in accordance with law. In view of the aforesaid, this petition is disposed of with a direction to the petitioner to approach the bank and if the petitioner approaches the bank, the bank shall make all endeavours to issue sale certificate by re-validating the current date as well as deliver the physical possession as expeditiously as possible.
