Judgment

ORDER This writ petition has been filed seeking a direction to the first respondent to consider the petitioner's representation dated 20.07.2026 to issue a public notification inviting applications / competitive bids before leasing the newly constructed commercial shops belonging to Nawab Chanda Mian Masjid and Meer Momin Madath Tomb Wakf by following the procedure prescribed under the Wakf Act and the applicable Rules, within a time frame.

¶2Mr. R. Sunil Kumar, learned counsel for the petitioner, would submit that the petitioner who is a Mahal resident of Nawab Chanda Mian Masjid and Meer Momin Madath Tomb Wakf situated at Mathalangulam Street, Tiruvannamalai, intends to do business by getting on lease, a shop, in the new commercial complex constructed by the said wakf; though the construction of the commercial complex is complete with 35 shops, so far no public notification has been issued calling for competitive bids for allotment of shops; hence, apprehending that the shops may be allotted privately in an arbitrary manner, thereby, causing financial loss to the waqf, the petitioner addressed a representation dated 20.07.2026 to the first respondent; since the same has not come to fruition, this writ petition has been filed seeking the aforesaid relief.

¶3Ms. N. Swathi Priya Raj, learned Standing Counsel, accepting notice for the respondents, would submit that the petitioner's representation dated 20.07.2026 will be considered within a period of eight weeks.

¶4Heard the learned counsel on either side and perused the materials available on record.

¶5Considering the limited scope of the relief sought in this writ petition, this Court, without expressing any opinion on the merits of the case, directs the first respondent to initiate action to bring the properties for auction by considering the petitioner's representation dated 20.07.2026, in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

¶6With the above direction, this writ petition stands disposed of. No costs. 07-08-2026 Index: Yes/No Speaking/Non-speaking order SRM
