¶2The case of the prosecution is that, due to enmity arising out of an alleged illegal relationship between one Rajapaari and the sister-in-law of the defacto complainant, a wordy quarrel ensued between Rajapaari and the defacto complainant's group. Subsequently, the petitioner, along with the other accused persons, allegedly formed an unlawful assembly and assaulted the defacto complainant and his friends with stones, due to which one Amith Kumar sustained injuries and succumbed to the same. Hence, the case.

¶3The learned counsel for the petitioner submitted that this is the second bail application filed by the petitioner. He further submitted that the allegations against the petitioner are false and that the petitioner has been in judicial custody since 07.06.2026. He further submitted that the charge sheet has been filed and the same was taken on file in P.R.C. No.9 of 2026. Hence, he prays to grant bail to the petitioner.

¶4The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner belongs to the State of Orissa. He further submitted that the charge sheet has been filed and the same was taken on file in PRC.No.9 of 2026 by the learned Judicial Magistrate, Rasipuram and now the case is posted on

27.08.2026 for the first appearance. Hence, he opposed the grant of bail to the Page3 of 4 Petitioner.

¶5I have given my anxious consideration to the submissions made by the learned counsel on either side and perused the materials available on record.

¶6Considering the submissions made by the learned counsel on either side, it is seen that the petitioner hails belong to the State of Orissa. Though the charge sheet has been filed, considering the gravity of the offence, this Court is not inclined to enlarge the petitioner on bail.

¶7Accordingly, this Criminal Original Petition is dismissed. 18-08-2026 DRL To
