M/S. Om Murugan Enterprises v. The Commissioner of Police

ORDER This petition has been filed seeking a direction to the Respondents, particularly the third Respondent, under the supervision of the first and second Respondents, to forthwith execute the Non-Bailable Warrant (NBW) issued by the learned Metropolitan Magistrate, Fast Track Court at Magisterial Level-II, Allikulam, Egmore, Chennai, in S.T.C. No. 16610 of 2025 against the accused, Ms. Shaheena, Proprietrix of M/s. Shoe Mandi, and to secure and produce her before the learned trial court.

¶2It is seen that the petitioner lodged a private complaint for an offence under Section 138 of the Negotiable Instruments Act, 1881, and the trial court took cognizance of the same in S.T.C. No. 16610 of 2025. Thereafter, the trial court issued summons to the counter-party/accused to appear before the court. Due to the non-appearance of the accused, a Non-Bailable Warrant was issued against her, which is currently pending execution on the file of the third respondent.

¶3In view of the above, the third respondent is directed to execute the pending NBW issued in S.T.C. No. 16610 of 2025 and produce the accused Page3 of 4 within a period of six weeks from the date of receipt of a copy of this order. The petitioner is directed to cooperate fully with the third respondent during the execution of the said warrant and provide the correct address of the accused to the third respondent.
