¶2The allegation against this petitioner is that the petitioner without qualification has attempted to obtain Immigration and VISA to study in USA fraudulently by producing fake documents to the defacto complainant/US Consulate General, on the basis of which the present case came to be registered.

¶3The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution. He further submitted that the petitioner is ready to abide by any stringent conditions imposed by this court. Hence, he prays to grant anticipatory bail to the petitioner.

¶4Per contra, the learned Government Advocate (Crl. Side) appearing for the respondent police reiterated the prosecution's case and, upon instructions, submitted that the petitioner has attempted to obtain VISA to study Master Degree in USA by producing fake documents and the respondent has issued notice under Section 41-A to the petitioner. Hence, he opposed the grant of anticipatory bail to the petitioner.

¶5Heard both sides and perused the materials available on record. Page3 of 5

¶6Considering the facts and circumstances of the case and the fact that the petitioner is a student and notice also issued to the petitioner under Section 41-A for enquiry and the petitioner is ready to abide by any stringent conditions imposed by this court, this Court is inclined to grant anticipatory bail to the petitioner, subject to certain conditions.

¶7Accordingly, the petitioner is ordered to be released on anticipatory bail in the event of arrest or on his appearance, within a period of fifteen (15) days from the date of receipt of a copy of this order before the learned CCB/CBCID Court, Egmore, Chennai, on condition that the petitioner shall execute a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand Only) with two sureties, each for a like sum to the satisfaction of the respondent police or the police officer who intends to arrest or to the satisfaction of the learned Magistrate concerned and on further conditions that:
