ORDER This Writ Petition challenges the impugned summons dated 10.08.2026 issued by the 3rd respondent.
¶2Upon hearing the learned counsel for the petitioner and perusing the material records of the case, the grievance of the petitioner is that the educational institution is being run by the petitioner by a trust namely Azad Educational trust and there was a dispute between the trustees as to who can run the office etc. The matter is already pending before the Civil Court and originally O.S.No. 235 of 2017 was decreed by the learned Additional Subordinate Judge, Mayiladuthurai, and an appeal suit in A.S.No.20 of 2018 Page3 of 5 was allowed by the learned District Judge, Mayiladuthurai, by a decree and Judgment dated 22.04.2026. Therefore, the petitioner and others who were aggrieved have already approached this Court by way of a Second Appeal in S.A.No.557 of 2026 and the same is pending. Thus when the matter is pending before the Civil Court, the Tahsildar, Mayiladuthurai, without any jurisdiction whatsoever has issued the aforesaid summons. There is no jurisdiction for the revenue authorities to settle the dispute between the trustees. Pursuant thereto, even the entry of the petitioner into the educational institution has been prohibited and therefore, the petitioner is before this Court.
¶3Per contra the learned Special Government Pleader taking notice on behalf of the respondents 1 to 3 would submit that whenever law and order situation arises on account of a civil dispute between the parties with reference to a property and to the limited extent of maintaining the law and order situation, in exercise of the power granted under section 164 of BNSS, the summons has been issued, for conducting a peace committee meeting between the parties by categorising them as a party 'A' and party 'B' and normally orders will be passed enabling the parties to approach the Civil Court and to maintain status quo until the orders are being obtained by the parties. In this case the impugned order is nothing but a summons for the meeting scheduled on
11.08.2026. Pursuant to which the meeting has already took place and no further order has been passed by the Tahsildar. Page4 of 5
¶4Upon considering the said submission made by the learned Special Government Pleader and since it is only a summons to attend the meeting on
11.08.2026 and it is stated that no further order has been passed by the Tahsildar, pursuant to the summons, no further grievance can be entertained by this Court. The parties will be ultimately be governed by the dictum of the Civil Court.
¶5With the above observation, this Writ Petition stands disposed of. No costs. Consequently, the connected miscellaneous petitions are closed. 13-08-2026 JER To
