ORDER With the consent of both sides, this Writ Petition is taken up for final disposal at the stage of admission itself. Page1 of 11
¶2The relief sought in this Writ Petition is to direct the Respondent to consider the e-mail dated 12.08.2026 sent by the Petitioner and consequently, include the Petitioner's name in the Provisional Rank List of candidates eligible for admission in the MBBS course 2026-2027 session under the Government Quota and Management Quota.
¶3The brief facts of the case are as follows: The Petitioner successfully passed the Class XII Main Examination, but, she secured only 11 marks in the Physics Theory Paper since she was having some medical issues at the time of examination. The Central Board of Secondary Education (CBSE) had issued the Marks Statement cum Certificate dated 13.05.2026 reflecting that she was required to repeat the Physics Theory Paper. Hence, Petitioner appeared for Class XII Supplementary Examination in Physics. In the meantime, Petitioner who has interest in studying MBBS attended the National Eligibility cum Entrance Test (UG) – 2026 Examination conducted by the National Testing Agency. The NEET examination results were published on 16.07.2026. The Petitioner secured 208 marks out of 720 marks in the NEET examination.
¶4After the publication of NEET examination results, Petitioner submitted an Application bearing Application No.26UG843830 before the Respondent seeking admission to the MBBS course under either the Page2 of 11 Government Quota or the Management Quota. The Respondent had published the Merit List for admission to the MBBS course on 10.08.2026. The Petitioner's name was not included in the Merit List for admission to the MBBS course. When Petitioner enquired about the same, Respondent informed the Petitioner that in the Class XII Mark Sheet of Petitioner, it has been mentioned that Petitioner has to repeat the Physics Theory Paper and hence, Petitioner was considered as ineligible for admission to the MBBS course. Though Petitioner had explained the Respondent that she already attended the Class XII Supplementary Examination and she would successfully clear the same.
¶5Considering the representations of the candidates those who have been found ineligible for admission to the MBBS course on account of non-submission of the requisite documents, Respondent vide Notification dated
11.08.2026, granted them a final opportunity to upload the missing documents from 12.00 p.m. on 11.08.2026 till 10.00 a.m. on 12.08.2026. However, the CBSC has released the Class XII Supplementary Examination – 2026 Results on 12.08.2026 at 5.00 p.m. The Petitioner secured 27 marks in Physics Theory Paper and passed the Physics Theory Paper, but she was unable to upload the requisite document since the Supplementary Examination Results were published only on 12.08.2026 at 5.00 p.m i.e., after the expiry of time given by the Respondent for uploading the requisite documents. Page3 of 11
¶6After the publication of Supplementary Examination Results by the CBSE, Petitioner addressed an e-mail dated 12.08.2026 to the Respondent requesting to include her name in the Rank List for selection and admission to the MBBS course, but, till date, there was no response for the Petitioner's request. Therefore, left with no other alternative, Petitioner has filed this Writ Petition for the relief stated supra.
¶7The leaned counsel for the Petitioner submitted that though Petitioner successfully qualified in the NEET Examination, her name was not included in the Merit List for admission to the MBBS course merely because of the reason that in the Main Senior School Certificate Examination, Petitioner had secured only 11 out of 70 marks in Physics Theory Paper and she failed in Physics Theory Paper.
7.1. It is further submitted by the learned counsel for the Petitioner that immediately after the publication of Class XII Main Examination Results, Petitioner attended the Class XII Supplementary Examination and secured 27 marks in Physics Theory Paper. Though Respondent granted a final opportunity for the candidates those who had been declared ineligible for admission to the MBBS course, to upload the requisite documents from 12.00 p.m. on
11.08.2026 till 10.00 a.m. on 12.08.2026, but, Class XII Supplementary Examination Results were published only on 12.08.2026 at 5.00 p.m. and hence, Page4 of 11 Petitioner could not upload the document pertains to Class XII Supplementary Examination Results within the time given by the Respondent.
7.2. The learned counsel for the Petitioner also submitted that the First Round of Counselling for admission to the MBBS course is in progress. The process of Choice Filling & Locking is available only till 5.00 p.m. on
19.08.2026 and the processing of seat allotment would be commenced on
20.08.2026. Therefore, the learned counsel prayed that Petitioner may be permitted to participate in the said First Round of Online Counselling currently being conducted by the Respondents.
¶8On the other hand, the learned Special Government Pleader appearing on behalf of the Respondent submitted that Petitioner did not secure qualifying marks in the Class XII Examination and hence, she was considered as ineligible for admission to the MBBS course.
8.1. It is further submitted by the learned Special Government Pleader for the Respondent that Respondent granted time to the candidates those who had been declared ineligible for admission to the MBBS course for uploading the requisite documents from 12.00 p.m. on 11.08.2026 till 10.00 a.m. on
12.08.2026, but, Petitioner has addressed an e-mail along with the Class XII Supplementary Examination Mark Sheet to the Respondent only after the expiry Page5 of 11 of time given by the Respondent for uploading the requisite documents.
8.2. The learned Special Government Pleader for the Respondent also submitted that under CBSE rules for Class XII, students must secure at least 33% overall in each subject. This requires a minimum of 23 out of 70 marks in the Theory Paper and 10 out of 30 marks in the Practical Paper to be declared as pass. In the present case, Petitioner secured only 11 out of 70 marks in the Physics Theory Paper and 30 out of 30 marks in Practical Paper, totally, 41 marks in Physics. To get admission to the MBBS course, an applicant must secure an aggregate minimum of 50% marks in Physics, Chemistry and Biology in Class XII Standard and qualify for the NEET. At the time of applying for admission to the MBBS course, Petitioner qualified in the NEET Examination, but, she did not secure qualifying marks in the Class XII Main Examination because she failed to pass in Physics Theory Paper. Therefore, Respondent did not include the Petitioner's name in the Merit List published on 10.08.2026.
¶9Heard the learned counsel on either side and perused the materials available on record.
¶10In the present case, Petitioner secured 11 out of 70 marks in the Physics Theory Paper and 30 out of 30 marks in the Practical Paper, totally, 41 marks in Physics. Since the Petitioner failed to pass the Physics Theory Paper, Page6 of 11 she appeared for Class XII Supplementary Examination in Physics. In the meantime, Petitioner attended the NEET Examination and secured 208 out of 720 marks in the NEET examination. Thereafter, she submitted an Application before the Respondent for admission to the MBBS course under either the Government Quota or the Management Quota, but, Petitioner's name was not found in the Merit List for admission to the MBBS course published on
10.08.2026 because she did not secure qualifying marks in the Class XII Main Examination. Under these circumstances, considering the representations of the candidates who have been found ineligible for admission to the MBBS course on account of non-submission of the requisite documents, Respondent granted a final opportunity for the candidates those who had been declared ineligible for admission to the MBBS course, for uploading the requisite documents from
12.00 p.m. on 11.08.2026 till 10.00 a.m. on 12.08.2026. While so, Class XII Standard Supplementary Examination Results were published on 12.08.2026 at
5.00 p.m and Petitioner secured 27 out of 70 marks in the Physics Theory Paper. However, Petitioner was unable to upload the requisite document since the Supplementary Examination Results were published only after the expiry of time given by the Respondent for uploading the requisite documents. Immediately, after the publication of Supplementary Examination Results, Petitioner sent an e-mail dated 12.08.2026 to the Respondent requesting to include her name in the Rank List for selection and admission to the MBBS course, but, there was no response for the same. Hence, this Writ Petition. Page7 of 11
¶11The main contention of the Petitioner is that though Petitioner did not secure qualifying marks in the Class XII Main Examination, she successfully qualified in the NEET Examination. The time given by the Respondent for uploading the requisite documents was expired at 10.00 a.m., on 12.08.2026, but, the Supplementary Examination Results were published only on 12.08.2026 at 5.00 p.m. Therefore, Petitioner was unable to upload the document related to Class XII Supplementary Examination Results within the time stipulated by the Respondent, but, immediately after the publication of Class XII Supplementary Examination Results, Petitioner has sent an e-mail to the Respondent and she has enclosed the Class XII Supplementary Examination Mark Sheet along with the said e-mail. Therefore, Petitioner may be permitted to participate in the First Round of Online Counselling currently being conducted by the Respondents.
¶12As far as this case is concerned, there is no fault on the part of the Petitioner. It is the fault of CBSE which published the Class XII Supplementary Examination Results belatedly on 12.08.2026 at 5.00 p.m. The purpose of conducting the Class XII Supplementary Examination by the CBSE is to afford a second chance to the students to pass the subjects in which they failed in the Class XII Main Examination and to prevent them from losing an entire academic year. It is the duty of the Respondent to communicate the counselling dates for admission to the MBBS course to all the Boards of Education across Page8 of 11 India so as to enable all the Boards of Education on the respective States to publish the Class XII Supplementary Examination Results prior to the counselling dates. It is not the Himalayan task for the Respondent. The Respondent can communicate the counselling dates for admission to the MBBS course to all the Boards of Education across India within five months time through e-mail or any other electronic communication. The Respondent should consider the interest of the students like Petitioner.
¶13Considering the above facts and circumstances of the case and having regard to the submissions made by the learned counsel on either side, this Court directs the Respondent to permit the Petitioner to upload the Class XII Supplementary Examination Mark Sheet through concerned online portal or submit it physically and also, permit her to participate in the First Round or subsequent round of Online Counselling either under the Government Quota or under the Management Quota subject to the qualifying marks secured by her in Class XII Supplementary Examination, on merit.
¶14This Writ Petition is disposed of with the above directions. No costs. Consequently, connected Miscellaneous Petition is closed.
